{"id":2436,"date":"2015-04-02T21:26:20","date_gmt":"2015-04-02T13:26:20","guid":{"rendered":"http:\/\/jlp-law.com\/blog\/?p=2436"},"modified":"2020-06-04T21:28:29","modified_gmt":"2020-06-04T13:28:29","slug":"criminal-complaints-and-damages-from-malicious-prosecution","status":"publish","type":"post","link":"https:\/\/pnl-law.com\/blog\/criminal-complaints-and-damages-from-malicious-prosecution\/","title":{"rendered":"Criminal Complaints and Damages from Malicious Prosecution"},"content":{"rendered":"\n<p>If the respondent (the person against whom the complaint is filed) in a criminal complaint wins, which means that the complaint is dismissed, is the respondent entitled to payment by the complainant (the person who filed the complaint)?<\/p>\n\n\n\n<!--more-->\n\n\n\n<div class=\"wp-block-image is-style-rounded\"><figure class=\"aligncenter size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"869\" height=\"655\" src=\"https:\/\/pnl-law.com\/blog\/wp-content\/uploads\/2020\/06\/Damages-for-Malicious-Prosecution.png\" alt=\"Damages for Malicious Prosecution\" class=\"wp-image-7870\"\/><\/figure><\/div>\n\n\n\n<p>As a rule, the respondent is not entitled to the payment of damages if the criminal complaint is dismissed. This appears to be wrong considering that the respondent, in defending the case, most probably hired and spent for a lawyer to defend the suit. However, every person has the right to file a complaint for redress of grievances. The mere filing of a complaint does not entitle the respondent to damages. Otherwise, as the Supreme Court noted, &#8220;peaceful recourse to the courts will be greatly discouraged and the exercise of one\u2019s right to litigate would become meaningless and empty.&#8221;<\/p>\n\n\n\n<p>On the other hand, the respondent may claim damages in a civil case for malicious prosecution.
