{"id":4220,"date":"2020-01-12T23:02:00","date_gmt":"2020-01-12T15:02:00","guid":{"rendered":"https:\/\/pnl-law.com\/blog\/?p=4220"},"modified":"2020-04-18T00:48:54","modified_gmt":"2020-04-17T16:48:54","slug":"abandonment-as-ground-for-legal-separation","status":"publish","type":"post","link":"https:\/\/pnl-law.com\/blog\/abandonment-as-ground-for-legal-separation\/","title":{"rendered":"Abandonment as Ground for Legal Separation"},"content":{"rendered":"\n<p>A petition for legal separation may be based on any of <a href=\"https:\/\/pnl-law.com\/blog\/grounds-for-legal-separation-under-the-family-code-of-the-philippines\/\">ten (10) grounds<\/a>, one of which is &#8220;abandonment of petitioner by respondent without justifiable cause for more than one year,&#8221; provided in <a href=\"https:\/\/pnl-law.com\/blog\/title-ii-legal-separation-family-code-of-the-philippines\/\">Article 55<\/a> of the <a href=\"https:\/\/pnl-law.com\/blog\/family-code-of-the-philippines-executive-order-no-209\/\">Family Code<\/a>. Abandonment as a ground for legal separation has three components:<\/p>\n\n\n\n<!--more-->\n\n\n\n<ul class=\"wp-block-list\"><li>1. There is abandonment;<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>2. It must be without justifiable cause; and<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>3. It must last for more than one (1) year.<\/li><\/ul>\n\n\n\n<p>Abandonment implies a departure by one spouse with the avowed intent never to return, followed by prolonged absence without just cause, and without in the meantime providing in the least for one&#8217;s family although able to do so. There must be absolute cessation of marital relations, duties and rights, with the intention of perpetual separation. (Partosa-Jo vs. Court of Appeals, G.R.
