This is provided under <a href=\"https:\/\/pnl-law.com\/blog\/financial-rehabilitation-and-insolvency-act-fria-of-2010-republic-act-no-10142-full-text\/\">Republic Act No. 10142<\/a>, also known as the <em>Financial Rehabilitation and Insolvency Act (FRIA) of 2010<\/em>, as fleshed out in the <em>Financial Rehabilitation Rules of Procedure (2013)<\/em> or \u201cFR Rules\u201d (A.M. 12-12-11-SC).<\/p>\n\n\n\n<!--more-->\n\n\n\n<div class=\"wp-block-image is-style-rounded\"><figure class=\"aligncenter size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"837\" height=\"627\" src=\"https:\/\/pnl-law.com\/blog\/wp-content\/uploads\/2020\/06\/Involuntary-Proceedings-in-Court-Supervised-Rehabilitation-Proceedings-under-the-Financial-Rehabilitation-and-Insolvency-Act.png\" alt=\"Involuntary Proceedings in Court-Supervised Rehabilitation Proceedings under the Financial Rehabilitation and Insolvency Act\" class=\"wp-image-8250\"\/><\/figure><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">WHO MAY INITIATE PROCEEDINGS<\/h2>\n\n\n\n<p>Any <a href=\"https:\/\/pnl-law.com\/blog\/glossary-for-the-revised-corporation-code\/#Creditor\">creditor<\/a> or group of creditors with a claim of, or the aggregate of whose claims is at least One Million Pesos or at least 25% of the subscribed capital stock or partners&#8217; contributions, whichever is higher, may initiate involuntary proceedings by filing a petition for rehabilitation of a <a href=\"https:\/\/pnl-law.com\/blog\/juridical-debtors-under-the-financial-rehabilitation-and-insolvency-act-fria-of-2010\/\">debtor<\/a> with the court and on the grounds hereinafter specifically provided.<\/p>\n\n\n\n<p>[See also <a href=\"https:\/\/pnl-law.com\/blog\/cross-border-rehabilitation-and-insolvency-actions-of-foreign-creditors-and-enforcement-framework-of-foreign-proceedings-in-the-philippines\/\">Cross-Border Rehabilitation and Insolvency: Actions of Foreign Creditors and Enforcement Framework of Foreign Proceedings in the Philippines<\/a>]<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">GROUNDS TO INITIATE INVOLUNTARY PROCEEDINGS<\/h2>\n\n\n\n<p>Involuntary proceedings may be initiated against the <a href=\"https:\/\/pnl-law.com\/blog\/juridical-debtors-under-the-financial-rehabilitation-and-insolvency-act-fria-of-2010\/\">debtor<\/a> by filing a petition with the court if:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>1. there is no genuine issue of fact or law on the <a href=\"https:\/\/pnl-law.com\/blog\/glossary-for-the-revised-corporation-code\/#Claim\">claim\/s<\/a> of the petitioner\/s, and that the due and demandable payments thereon have not been made for at least 60 days; or<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>2. the <a href=\"https:\/\/pnl-law.com\/blog\/juridical-debtors-under-the-financial-rehabilitation-and-insolvency-act-fria-of-2010\/\">debtor<\/a> has failed generally to meet its liabilities as they fall due; or<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>3. at least one <a href=\"https:\/\/pnl-law.com\/blog\/glossary-for-the-revised-corporation-code\/#Creditor\">creditor<\/a>, other than the petitioner\/s, has initiated foreclosure proceedings against the debtor that will prevent the debtor from paying its debts as they become due or will render it <a href=\"https:\/\/pnl-law.com\/blog\/glossary-for-the-revised-corporation-code\/#Insolvency\">insolvent<\/a>.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">CONTENTS OF THE PETITION FOR INVOLUNTARY PROCEEDINGS<\/h2>\n\n\n\n<p>The petition for rehabilitation shall be verified to establish the substantial likelihood that the debtor may be rehabilitated. The petition shall include:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>1. the name, business, and principal address and other known addresses of the debtor;<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>2. the nature of the business and the principal activities of the debtor;<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>3. the circumstances sufficient to support a petition to initiate involuntary rehabilitation proceedings;<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>4. the specific relief sought;<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>5. a <a href=\"https:\/\/pnl-law.com\/blog\/rehabilitation-plan-in-court-supervised-rehabilitation-proceedings\/\">Rehabilitation Plan<\/a>;<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>6. the names of at least 3 nominees to the position of <a href=\"https:\/\/pnl-law.com\/blog\/the-rehabilitation-receiver-management-committee-and-creditors-committee-in-corporate-rehabilitation-proceedings\/\">rehabilitation receiver<\/a>, as well as their qualifications, office and email addresses;<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>7. the exact address\/es at which documents regarding the debtor and the proceedings may be reviewed and copied, if known to the petitioner\/s; and<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>8. documents showing that there is substantial likelihood that the debtor may be rehabilitated.&nbsp;<\/li><\/ul>\n\n\n\n<figure class=\"wp-block-table\"><table><tbody><tr><td>&nbsp;<\/td><td>OTHER COMMON PROVISIONS:<\/td><td>&nbsp;<\/td><\/tr><tr><td>&nbsp;<\/td><td>*&nbsp;<a href=\"https:\/\/pnl-law.com\/blog\/court-supervised-rehabilitation-proceedings-under-the-financial-rehabilitation-and-insolvency-act-fria-of-2010\/\">Action of Court and Proceedings<\/a><\/td><td>*&nbsp;<a href=\"https:\/\/pnl-law.com\/blog\/rehabilitation-plan-in-court-supervised-rehabilitation-proceedings\/\">The Rehabilitation Plan<\/a><\/td><\/tr><tr><td>&nbsp;<\/td><td>*&nbsp;<a href=\"https:\/\/pnl-law.com\/blog\/commencement-order-in-court-supervised-rehabilitation-proceedings\/\">The Commencement Order<\/a><\/td><td>*&nbsp;<a href=\"https:\/\/pnl-law.com\/blog\/the-rehabilitation-receiver-management-committee-and-creditors-committee-in-corporate-rehabilitation-proceedings\/\">The Rehabilitation Receiver<\/a><\/td><\/tr><tr><td>&nbsp;<\/td><td>*&nbsp;<a href=\"https:\/\/pnl-law.com\/blog\/stay-order-or-suspension-order-in-court-supervised-rehabilitation-proceedings\/\">Stay or Suspension Order<\/a><\/td><td>*&nbsp;<a href=\"https:\/\/pnl-law.com\/blog\/management-committee-in-court-supervised-rehabilitation-in-the-philippines\/\">The Management Committee<\/a><\/td><\/tr><tr><td>&nbsp;<\/td><td>*&nbsp;<a href=\"https:\/\/pnl-law.com\/blog\/determination-of-claims-in-court-supervised-financial-rehabilitation-in-the-philippines\/\">Determination of claims<\/a><\/td><td>*&nbsp;<a href=\"https:\/\/pnl-law.com\/blog\/creditors-committee-in-court-supervised-rehabilitation-in-the-philippines\/\">The Creditor\u2019s Committee<\/a><\/td><\/tr><tr><td>&nbsp;<\/td><td>*&nbsp;<a href=\"https:\/\/pnl-law.com\/blog\/secured-creditors-in-court-supervised-rehabilitation-proceedings\/\">Treatment of secured creditors<\/a><\/td><td>*&nbsp;<a href=\"https:\/\/pnl-law.com\/blog\/avoidance-proceedings-in-court-supervised-rehabilitation-proceedings-for-juridical-persons\/\">Avoidance proceedings<\/a><\/td><\/tr><tr><td>&nbsp;<\/td><td>*&nbsp;<a href=\"https:\/\/pnl-law.com\/blog\/termination-of-court-supervised-rehabilitation-proceedings\/\">Termination of proceedings<\/a><\/td><td>&nbsp;<\/td><\/tr><\/tbody><\/table><\/figure>\n","protected":false},"excerpt":{"rendered":"<p>Involuntary court-supervised rehabilitation proceedings, as opposed to voluntary court-supervised proceedings, is initiated by the creditors.
