{"id":7872,"date":"2007-06-04T23:18:00","date_gmt":"2007-06-04T15:18:00","guid":{"rendered":"https:\/\/pnl-law.com\/blog\/?p=7872"},"modified":"2020-06-04T23:20:54","modified_gmt":"2020-06-04T15:20:54","slug":"citizenship-retention-and-re-acquisition-act-of-2003-republic-act-no-9225-full-text","status":"publish","type":"post","link":"https:\/\/pnl-law.com\/blog\/citizenship-retention-and-re-acquisition-act-of-2003-republic-act-no-9225-full-text\/","title":{"rendered":"Citizenship Retention and Re-acquisition Act of 2003 (Republic Act No. 9225): Full Text"},"content":{"rendered":"\n<h2 class=\"has-text-align-center wp-block-heading\">REPUBLIC ACT NO. 9225<\/h2>\n\n\n\n<h4 class=\"has-text-align-center wp-block-heading\">AN ACT MAKING THE CITIZENSHIP OF PHILIPPINE CITIZENS WHO ACQUIRE FOREIGN CITIZENSHIP PERMANENT, AMENDING FOR THE PURPOSE COMMONWEALTH ACT NO. 63, AS AMENDED, AND FOR OTHER PURPOSES<\/h4>\n\n\n\n<!--more-->\n\n\n\n<p><strong>SECTION 1.&nbsp;<em>Short Title<\/em><\/strong><em>. \u2013&nbsp;<\/em>This Act&nbsp;shall be&nbsp;known as&nbsp;the &#8221;Citizenship Retention&nbsp;and&nbsp;Re-acquisition&nbsp;Act&nbsp;of&nbsp;2003.&#8221;&nbsp;<\/p>\n\n\n\n<p><strong>SEC. 2.&nbsp;<em>Declaration of Policy<\/em><\/strong><em>.&nbsp;<\/em>\u2013 It is hereby the policy of the&nbsp;State that Philippine citizens who become citizens of another country shall be deemed not to have lost their Philippine citizenship under the conditions of this Act.<\/p>\n\n\n\n<p><strong>SEC.&nbsp;<em>3 . Retention of Philippine<\/em><\/strong><em>&nbsp;Citizenship<\/em>. \u2013 Any&nbsp;provision&nbsp;of law to the&nbsp;contrary&nbsp;notwithstanding, natural-born&nbsp;citizens&nbsp;of&nbsp;the&nbsp;Philippines who&nbsp;have lost their&nbsp;Philippine citizenship by&nbsp;reason&nbsp;of&nbsp;their&nbsp;naturalization&nbsp;as&nbsp;citizens of&nbsp;a&nbsp;foreign country&nbsp;are&nbsp;hereby deemed to have re-acquired Philippine citizenship&nbsp;upon taking the&nbsp;following oath of allegiance to the Republic:&nbsp;<\/p>\n\n\n\n<p>\u201cI _________________, solemnly s<em>wear\u00a0<\/em>(or\u00a0affirm) that\u00a0I\u00a0will\u00a0support\u00a0and defend the Constitution of the Republic of\u00a0the\u00a0Philippines and obey the laws and legal orders promulgated by the duly constituted authorities of the Philippines; and\u00a0I\u00a0hereby declare that\u00a0I\u00a0recognize and accept the supreme authority of the Philippines and will maintain true faith and allegiance thereto; and that\u00a0I\u00a0impose this obligation upon myself voluntarily without mental reservation or purpose of evasion.&#8221;<\/p>\n\n\n\n<p>Natural-born citizens of the Philippines who, after the effectivity of this Act, become citizens of a foreign country shall retain their Philippine citizenship upon taking&nbsp;the&nbsp;aforesaid&nbsp;oath.&nbsp;<\/p>\n\n\n\n<p><strong>SEC. 4.&nbsp;<em>Derivative Citizenship<\/em><\/strong><em>.<\/em>&#8211;&nbsp;The&nbsp;unmarried child, whether legitimate, illegitimate or adopted, below (18) years of age, of those who re-acquire Philippine citizenship upon effectivity of this Act&nbsp;shall&nbsp;be deemed citizens of the Philippines.&nbsp;<\/p>\n\n\n\n<p><strong>SEC.&nbsp;<em>5.&nbsp;<\/em><\/strong><strong><em>Civil and&nbsp;Political Rights and Liabilities<\/em><\/strong><em>.&nbsp;<\/em>\u2013&nbsp;Those&nbsp;who&nbsp;retain&nbsp;or re-acquire Philippine citizenship under this Act shall enjoy full civil and political rights and be subject to all attendant liabilities and responsibilities under existing laws of the Philippines and the following conditions:<\/p>\n\n\n\n<p>(1) Those intending to exercise their right of suffrage must meet the requirements under Section 1, Article V of the Constitution, Republic Act No. 9189, otherwise known as \u201cThe Overseas Absentee Voting Act of 2003\u201d, and other existing laws;<\/p>\n\n\n\n<p>(2) Those seeking elective public office in the Philippines shall meet the qualifications for holding such public office as required by the Constitution and existing laws and, at the time of the filing of the certificate of candidacy, make a personal and sworn renunciation of any and all foreign citizenship before any public officer authorized to administer an oath;<\/p>\n\n\n\n<p>(3) Those appointed to any public office shall subscribe and swear to an oath of allegiance to the Republic of the Philippines and its duly constituted authorities prior to their assumption of office: Provided, That they renounce under oath of allegiance to the country where they took that oath.&nbsp;&nbsp;<\/p>\n\n\n\n<p>(4) Those&nbsp;intending to&nbsp;practice their profession in the Philippines shall apply with the proper authority for a license or permit to engage in such practice; and&nbsp;<\/p>\n\n\n\n<p>(5) That right to vote or be elected or appointed to any public office in the Philippines cannot be exercised by, or extended to, those who:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>(a) are\u00a0candidates\u00a0for or are occupying any public office\u00a0in\u00a0the country of which they are naturalized citizens; and\/or\u00a0<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>(b)\u00a0are in active service as commissioned or non-commissioned officers in the\u00a0armed\u00a0forces of the country which they are naturalized citizens.\u00a0<\/li><\/ul>\n\n\n\n<p><strong>SEC.&nbsp;<em>6.
