We previously noted that infidelity is not, by itself, a ground for annulment, although it could be a basis for legal separation or filing a case for adultery/concubinage. As to custody, the Supreme Court already ruled that sexual infidelity, by itself, is not sufficient to grant custody over a child. Let’s continue the discussion on these concepts:
What is concubinage?
Concubinage is committed by any husband who shall keep a mistress in the conjugal dwelling, or, shall have sexual intercourse, under scandalous circumstances, with a woman who is not his wife, or shall cohabit with her in any other place (Article 334 of the Revised Penal Code or RPC).
What is adultery?
Adultery means the carnal relation between a married woman and a man who is not her husband, the latter knowing her to be married, even if the marriage be subsequently declared void (RPC, Article 333). Each sexual intercourse constitutes a crime of adultery.
Adultery vs. Concubinage
1. Adultery is committed by a wife (who must also be charged together with the other man), while concubinage is committed by a husband (who must be charged together with the concubine).
2. Proof of sexual intercourse is enough in adultery, but in concubinage, the prosecution must prove that the sexual intercourse must be under scandalous circumstances, or that the husband kept a mistress in the conjugal dwelling or cohabited with her in any other place.
3. The penalty for concubinage is lower than that of adultery. The penalty for the concubine is only destierro, while the penalty for the man other in adultery is the same as that of the guilty wife.
What is destierro?
Destierro means banishment or only a prohibition from residing within the radius of 25 kilometers from the actual residence of the accused for a specified length of time. It is not imprisonment. [See Destierro: Definition, Nature and Jurisdiction]
Who can file the action for adultery or concubinage?
Only the offended spouse can legally file the complaint for adultery or concubinage. The marital status must be present at the time of filing the criminal action. In other words, the offended spouse must still be married to the accused spouse at the time of the filing of the complaint.
Who must be prosecuted?
The offended party cannot institute the criminal charge without including both guilty parties (the offending spouse and the paramour), if both are alive.
What is the effect of consent or pardon by the offended spouse?
The criminal charge cannot prosper if the offended spouse has consented to the offense or pardoned the offenders. Pardon can be express or implied. An example of express pardon is when the offended party in writing or in an affidavit asserts that he or she is pardoning his or her erring spouse and paramour for their act. There is implied pardon when the offended party continued to live with his spouse even after the commission of the offense. Pardon must come before the institution of the criminal action and both offenders must be pardoned by the offended party.
What is bigamy?
Bigamy is basically the act of marrying again while the first marriage is still subsisting. It is defined under Article 349 of the RPC as the contracting of a second or subsequent marriage before the former marriage has been legally dissolved, or before the absent spouse has been declared presumptively dead by means of a judgment rendered in the proper proceeding.
What are the elements that must be proved in a prosecution for bigamy?
In a case for bigamy, all the following matters or “elements” must be shown by the prosecution:
- 1. The offender has been legally married.
- 2. The marriage has not been legally dissolved or, in case his or her spouse is absent, the absent spouse could not yet be presumed dead according to the Civil Code.
- 3. He/she contracts a second or subsequent marriage.
- 4. The second or subsequent marriage has all the essential requisites for validity.
What is the effect of a pending petition for annulment or a declaration of nullity of marriage on a criminal case for bigamy?

How is bigamy different from adultery/concubinage?
In adultery/concubinage, the law requires that both culprits, if both are alive, should he prosecuted or included in the information. In bigamy, the second spouse could be charged only if she/he had knowledge of the previous undissolved marriage of the accused. Bigamy is a public offense and a crime against status, while adultery and concubinage are private offenses and are crimes against chastity. In adultery/concubinage, pardon by the offended party will bar the prosecution of the case, which is not so in bigamy.
What if I killed or injured my spouse when I caught him/her in the act of committing sexual intercourse with another person?
The law provides that “any legally married person who, having surprised his spouse in the act of committing sexual intercourse with another person, shall kill any of them or both of them in the act or immediately thereafter, or shall inflict upon them any serious physical injury, shall suffer the penalty of destierro” (RPC, Article 247). The accused spouse, which could be the husband or the wife, must prove the following:
- 1. A legally married person (or a parent) surprises his spouse (or his daughter, under 18 years of age and living with him), in the act of committing sexual intercourse with another person.
- 2. He or she kills any or both of them or inflicts upon any or both of them any serious physical injury in the act or immediately thereafter.
- 3. He has not promoted or facilitated the prostitution of his wife (or daughter) or that he or she has not consented to the infidelity of the other spouse.
The accused must proved that he/she actually surprised the other spouse in flagrante delicto (or in the act of doing the deed), and that he/she killed the other spouse and/or the other party during or immediately thereafter.

If your husband enter into subsequent marriage then he is liable of the crime bigamy. Yes, you can be free from your marriage. May be you can file for annulment.

Same situation, however my partner and his wife has been separated for 6 years (not legally) when we start our relationship. They have 2 kids, before my partner he is trying to support his children but his wife said “no need”.
Now we are at 6 years living together with 2 daughters. His wife knows all about these. Recently she is contacting my partner asking for support which my partner cannot provide and he just sent what he can afford. A – husband
C – wife; an ex-girlfriend for 7years
E – husband has a child with this woman; workmate and unofficial girlfriend for few months, say 6months

here we go.
Dec 2008 – E and A were living on a same apartment and now E was pregnant to A. At first, E wasnt so grateful to have a child to this man bec she’s still engaged with her boyfriend for 5years. So E had to break up with M on March 2009. Prior to this, A was so intimated with the fact that E still loves M and was thinking that E is just making him believe that she wants him. A was thinking that E is just living with him becauseof the child. On May 2009, A left the apartment and didnt show up for a week. E had been constantly making a neffort to talk to a via calls, sms and emails. A promsied that he’d comback but this show up only after 3months, August 2009. While A is away, C had befriended E so as to get information about her relationship with A. In deep pain, E was saying (thru sms) to C that she doesnt want A and E regrets to have A in her life. Now, C was showing those messages to A making A angry to E but still not talking to E. Still in May, A texted E that he was to marry another woman who was pregnant to him as well prior to E’s pregnancy and that same day A had to attend their marriage. E wasnt aware that this one is just a bluff but for her A wouldnt really do that to her. To sum it up, C triggered the anger of A to E though A loves E so much. It is C who planned for the ghost marriage (didnt really happened) so that E would no longer be persisten tabout A. A and E didnt talk from then on. After sometime in July 2009, C asked A to marry her so that E wouldnt get anything from A just in case the baby will be born. C was so bitter because A dropped her before and she couldnt win him back. A, who was so upset with E, accepted the idea of marrying C since C was so persistent to have A. The marriage was just an arranged marriage in the Manila City Hall. When they arrived there, They just signed for something and then paid someone whom we can call a fixer. Now in August 2009, A and E met again and they reconciled. E didnt know anything only after a week when C, who is in a foreign country now, told E that she’s married to A. A told E that he didnt want the marriage. It’s just that he lost hope that E will comeback to her. Can A file for fraud and have this nullified? Or is it voidable? Cause A wanted to marry E.

Such kind of marriage is void ab initio for lack of essential requisites.
The essential requisites include:
Legal capacity of the contracting parties, who must be male and female; and
Consent freely given in the presence of the solemnizing officer.
On the other hand, the formal requisites are:
Authority of the solemnizing officer;
A valid marriage license except in the certain circumstances;
A marriage ceremony which takes place with the appearance of the contracting parties before the solemnizing officer and their personal declaration that they take each other as husband and wife in the presence of not less than two witnesses of legal age.
The absence of any of the essential or formal requisites make the marriage void ab initio. However, the distinction between the classifications become material in case there are defects or irregularities in the requisites.

A cannot file annulment on the basis of vitiated consent. The circumstances in the case at bar does not apply to the circumstances provided under Art. 46 of the Family Code that constitute “FRAUD”. Concealment by the wife of the truth behind the relationship of her husband and another woman which in turn resulted to the husband’s abandonment to the other woman and eventually caused the marriage of the husband and wife doesn’t give grounds for action for annulment of marriage.

So my friend got his ex-girlfriend pregnant, however this girl is married to another man but was separated about 10 years already with no legal separation. As per ex-girlfriend, this was an act of abandonment. Now going back, the girl has been demanding for a child support from my friend since he gave his last name to the child. the question is : 1. is it legal that my friend’s last name is used by the child even thou the girl is still legally married to another man.

Sir, in my own opinion, either of you and your live in partner have no rights to file any of legal actions even though you’re living together for 20 years because you’re not legally married. As far as i know, those grounds is only for legally married couples only.

He is married and has 2 kids and i accept that our relationship is a result of him falling out of love for his old and lazy wife. Though I love him unconditionally. Right now I am in Manila, he is working in UAE and his family in the province. He is still supporting his family financially. But things are different now that I am leaving for the states and I can’t take him with me because he is married. I still want him to get annulment first to be safe.

I am separated and living with another woman to whom I have a 2 year old son. In the course of our living together, many arguments, fights ensued which led to both physical and verbal abuse which happen more often that not. She has also verbally abused my parents and certain relatives.
I have started to document the physical abuse by taking pictures of scratches and bruises that I have experienced. My parents including some relatives would validate such.
At this point I would like to sever the relationship but am under threat that :
1. She would reveal to my legal wife that we have been living together and have a child so that my legal wife can file a concubinage or adultery case against me.
2. She would scandalously make a scene particularly in my office, and make calls to expose our immoral relationship so I can get fired from work.

I got married (civil) to a British national in NOV 2006 in angeles pampanga, and after only 3 months he left after we had argument about his real person and never saw him again. He have threatened me through chat and email, financially and emotionally crippled me. When i heard from him late DEC 2007 only to receive email with copy of his marriage certificate to another woman in UK. And when i ask him why did he not get divorce first his reply was he never registered our marriage in UK so no reason for him to file divorce and he does not plan to come back and pay for annulment he wanted me to suffer and not be able to re-marry or have a life. I was told that if he gets divorce in UK it will be honored here. So one time i was able to scare him of bigamy and get him to talk to divorce lawyer in UK but after they sent me draft of proposed divorce and after i sent them documents they ask for i got message from his solicitors saying that my ex or husband did not go back and not pushed through with the case. He knew i do not have the capability to file case because i don’t have enough money, so he just played and fooled me to believing that he was going to take care of it. What kind of law or country do we have if it can not even protect the rights of it’s citizens. I am financially broke, i have one daughter from previous relationship who is in college and can not afford to file annulment or even bigamy since i do not know how he can be persecuted, it has been almost 5 years am suffering from abandonment and not being able to move on and have new life due to our Philippine laws. My husband and I are separated 3 years now. I returned him to his parents because I found out that he cheated on me. And a lot of my friends and neighbors sighted him with different girls during our separation (not legal only verbal). He wanted us back (with my two sons) but really I can’t bear with him anymore, he’d hurt me a lot during the time we are living together.
At present I am living with a partner, the same with my husband he has also a girl and they are also together. The kids are in my custody. I want to have my kids properly supported because they are schooling now. in the child abuse:
it was the first day of school of the mistress son and daughter, they were schoolmates of my brother. My mother went to the school and search the rooms of the son and daughter of the mistress. going to the school was one way for my mother to talked to them to please their mother to stay away from my father because the mistress can’t be find no where at that time, i think she was really hiding. we already pleases her to have a talked but she didn’t showed up.
My mother asked already from the teacher of the daughter of the mistress to have a talked with the child just outside the door of their classroom, so the teacher approve. my mother was really begging to the child to talked to their mother to stay away from my father, so it was really a pleased but it resulted that the child who was 14 y/o at that time spoke some unnecessarily words to my mother telling: “you must discipline your husband and not my mother at all because it’s was your husband’s fault.. your just like a dwarf in your height!”—so the child really indeed insulted my mom..
–regarding with their cased filed against my mom,, they make the story that my mom hurts the child physically which in fact it was not true at all. my mom already have the certificate from the division principal of the school that there was no maltreatment or physical injury happened to the child at the school premises and there was no complaint at that time. so it was shown that they really have a false sayings just to provoked my mom.

my mom and my brother who was 14 y/o at that time was busy delivering some items from those neighboring houses. my mom used to be a dealer of garments, make-ups and etc. when accidentally, they had seen the mistress visiting their house before, so it was not her already, so my mom called the mistress and asked for a mannerly talked, so the mistress allowed my mom to went inside the house and walked up to the second floor when suddenly the mistress was already holding a steel and she pushes my mom down from the stairs which causes my mom to have some bruises from here body and head, so that was the scenario when they had a physical fight which was in the first place the mistress was the one who started it.

I’m married for 4 yrs, Got married last 2009, one week after, I gave birth to my daughter, after 5 months,I found out that one month before we got married is He’s having an affair with his co-worker,before I knew it the girl was visiting my daughter in my house giving things, after few days, I tried to check my husband’s phone and I’ve read that they’re fighting and he confessed and asked for forgiveness that they are having an affair. we even went to Makati, which his Grand Mother’s house is located , which he stays because its near his office, and to find out that the Girl is already staying and renting a room. the 3 of us talked about the situation, and my husband promised me that he’ll put up an end on what they have, he decided to stop working then I decided to work, we had a small fight that ends up with bruises in my face and body, then he left with my daughter, for 6 months that I haven’t seen my daughter because he wont let me, we talked about our problems, and I asked for his forgiveness even It’s not my fault, then his friend told me that my husband and his mistress still have a relationship, the girl is texting me to surrender my husband to her because he doesnt love me at all. so I talked to my husband and then he asked for forgiveness again, after that, he accused me that i’m having an affair with my co worker, which is not true, there is someone who liked me but i refused, my boss liked the guy and when the guy confessed to her that he liked me my boss talked to my husband and tell everything that isn’t true, 2 yrs of not seeing my daughter because of his father’s condition that if i force to see my daughter he will not let my parents visit their grand daughter. so even its hard for me I accepted. I found out last year his mistress gave birth, and they stay in one roof with my daughter, my parents regularly visits my daughter and coming out in my daughters mouth they found out about my husband’s mistress, not only that they even brainwash my daughter’s mind that if she sees me she must run away because i will hurt her, good thing about this my parents is building me up. and my daughter still knows me, last year, I met this guy which is my partner in our business he told me that he likes me and i have the same feeling. we have this relationship for a year, can I still have the custody of my daughter, would it be charged for abundanment even my husbands condition, and before he told me that he will file a case which is adultery, even when he is the first to have a mistress. and now they have a child, can i file a case for concubinage? can i also file a case of violence against women. because he’s hurting me physically. I really want to have the custody of my child legally but my husbands has the capabilities to hire someone then kill me, or even himself, and also he was deported back here in the philippines because he was in jail for 3 yrs because of the case illegal possession of drugs and firearms. can this situation helped me for having my daughter back?. please I need an answer.

He asked me to sign a blank paper saying that he will consult his lawyer to produce a letter stating that I cannot oblique him for our children’s maintenance.
I never love him and he just rape me, when I got pregnant I always wanted to escape from him but unfortunately my parents insist to send me back to him.
Because they will not allow me to live with them as an additional expenses to them that since I bore a child with him, I should make him take care of me and my children.
I manage to go and work abroad without realising he had produced a fake marriage certificate and I don’t know how he manage to forward it to NSO declaring I am married to him.
I just found out recently with NSO that this marriage certificate exist after applying for a CENOMAR.
The time I went abroad 20 years back then I met a US citizen and we got married, assuming I am still single in my country they never required anything from me in order to marry my US husband.
After 20 years I went home using my US passport. I was told by my own mother that I have a marriage certificate with this Filipino.
Due to curiosity I applied for a CENOMAR and it did say that I am married to this Filipino and also married to my US husband. What do I need to do?
I am now just US passport holder and US citizen alone, I am no longer Filipino citizen or dual passport holder.
What is my status? Do I need to file for an annulment even though I am not aware of this marriage existence?
BTW, this Filipino man is now in jail for drug dealing Section 5/11 Article II.

Hi, i have a question, last 2013 i found out that my husband is living with another woman and that the woman was pregnant, we never separate for some reason except when my job brought me to Aklan,, when i was in aklan already a rumor surprised me i talked to him every night at phone and i didnt know there was a problem like him having an affair with another woman,,, so when i found out about it i called him and right when i confronted him that the rumor says he got this woman pregnant for 5 month already,, he turned off the phone,, that very same day i was able to confirm it from his sister.. that they r living together already in manila and that the woman was not pregnant but gave birth already sept 2012… from there i chose to keep my space and waited for the right time to get back to them,,,, now i have all the pictures they posted on facebook as a family and i got an n.s.o. cert, of the chill acknowledged by him meaning the child is registered under his name..

He also discovered from my son that during his on board, that guy went to our home several times during occasions (with my mom around). he slept in our living room once or twice when that guy visited in our house but I told my husband that he is just a friend of mine. I couldn’t blame my husband if he thinks I cheated on him. But I explained to him that he himself is the reason why I’ve lost my trust and love for him. I told my husband my willingness to fix our relationship again and to try to put back all the way it was before but when he discovered about my officemate, he renounced me and didn’t believe my explanations. He commanded me and my mother to go and leave our home right away even after denying about his accusations.. He also demanded our child’s custody (who’s 10 years old) with an arrangement that my son will be studying and staying with him during weekdays while weekend is mine. He doesn’t also allow our child to spend his summer vacation with me because he want to stick with the schedule arrangement whether vacation or not- weekdays is his while weekend is mine. He also told me not to claim all my rights as his spouse (conjugal properties including allotment while his in abroad) and he’s demanding my share for my son’s necessities. It seems that he’s too demanding that he dictates all in his favor. I am afraid because he is threatening me that he will revenge. my officemate told me that my husband went to his company employer and revealed to the Board of Partners about our suspicious affair showing the printed facebook conversation as evidence. He also told this problem to all his family, to some of my relatives, to his friends, to the neighbors and to the school principal and teachers of my son. Now, I am living in my mom’s home. Our conjugal house was lived by my in-laws. Allotment is also received by my in-laws and my son is now living with them while my husband is on board. This really affects my dignity.
Queries: Does my husband has a chance to win if he sue me for adultery and can get me into jail?
If he file an annulment on grounds of adultery and was found guilty, will I still be sent into prison?
How about my child’s custody? What if he force my child to stay with him or with my parent-in-laws if he’s away? What should I do? How can I win my child’s custody?
Lastly, can I counter attack? Is there a chance for me to file a case against him? if yes, what would it be? does my office mate need to file a case against him? If yes and if there’s a higher chance for us to win the case, would my husband be permitted to go abroad during the trial?

I only have some questions about a man don’t wanna go back to his wife again because of some reasons.
The husband discovered that his wife cheated him because their youngest son died because of an accident he went home and the moment he arrived he noticed that his wife is pregnant about 5-6 months but he is sure that his wife got pregnant from other guy because they don’t have contact because he is working in manila and his wife and kids living in certain province.
The guy decided to go back to his work again but before that he confronted his wife in a Barnhart together with the officials because he want to settle an agreement that they will not bother to each other but he will support their kids but no longer his wife because she cheated .
After several years the husband found another woman and they have 1son but the wife is bothering them and threatening that she will accused her husband because of having another family.

Doon na po ako nabahala kaya nagpatulong po ako sa lawyer dito sa amin. Kaya pinadalhan siya ng demand letter. After that nagbigay lng xa ng konti ng ilang months. Pagkatapos stop ang pagpapadala niya kaya pinadalhan siya ulit ng second demand letter which is stated kung magkano ang ibigay niya sa amin. Nagbigay mn xa pero konti pa rin at hindi sapat sa dalawa naming anak. 1 to 2 thousand lng ibigay niya buwan buwan. Malaki na mga anak namin. Ang panganay grade7 at ang bunso grade 4. Pero ilang buwan lng kasi nagagalit ang live in partner niya. Ayaw daw niya na may kahati xa sa lahat. Kaya napilitan abogado ko na magpadala ng last and final demand letter. Kaya nagpilitan nanaman siyang mgpadala pero 1k lng. Ilang buwan lng din hindi nanaman xa nagpadala. Pero bago yun kinausao niya ang mga bata na pakiusapan ako na hindi na lng magdemanda sa kanya kasi daw kapag nakulong xa wala na siyang maibigay na tulong. Mga anak namin ang nakiusap sa akin kaya hindi ko po tinuloy ang pagfile ng abandonment. Tapos hindi na rin po xa nagpadala. Nagpadala xa ulit last March pam bday daw ng mga bata. 2 thousand po pinadala niya. Yun pala kasi nag apply na xa para seaman po. Iyon lng huli niyang padala. Tapos ngayon po malapit na siyang paalis kaya lng kailangan niya yung ipina pa open na bank account sa akin para sa mga bata. Bale 3 po kami, mama jiya, babae niya at ako. Ang masaklap po sa lahat ng ginawa ko sa kanya ako pa rin at mga anak ko ang huli sa option. Bakit? Ang ibigay daw niya na allotment sa amin konti lng sapat daw pagkain sa mga bata at baon. At reason niya dahil may iba na daw ako ngayon. Noon wala konti lng, ngayon may iba na ako konti pa rin. Minsan nga muntik na mamatay anak nmin dahil sa dengue ni pisong tulong wala siyang ibinigay sa amin. Tapos siya at pamilya pa nagagalit sa akin ngayon kasi hindi pa po ako nag open ng bank account sa bpi. Sabi ko po sa kanya hihingiin ko ang para sa mga bata, kahit pa sinabing 80% talaga dapat mapunta sa amin kahit 60% na lng para nman may maibigay xa sa mama niya at sa ka live in partner niya kasi may anak sila. Lalo siyang nagalit nung sinabi ko na kung ayaw niya kasi ayaw talaga niya pupunta kami ng mga bata sa poea at doon kami mgreklamo. Sinabihan po niya ako na kapag ginawa ko daw mas lalo daw wala siyang ibibigay sa amin. Sisigutadohin daw po niya na zero kami. Tanong ko po attu., pwede po ba na zero kami? Kami yung legal, kami yung iniwan at inabandonar… 2nd question po, magkano po ba talaga ang dapat sa amin ng mga anak ko? My husband had been cheating on me for a little while. When we first separated, I thought we were just taking a break. Then he started telling me, that it was all my fault I didn’t show that I appreciated him, or showed him love. For a about a year & a half. My wife proclaimed us “separated” back in October 2016; however, she never moved out of my house. She wanted to remain living here instead of moving in with her mom. I wanted to work things out so I agreed she could live here. Since then she has been partying, drinking and smoking marijuana. All that she has openly admitted to. Also, she has openly admitted to committing adultery on two separate occasions with two different men. We have a child together and all I wanted to do is be able to work things out. She on the other hand does not. With this being said, we still occasionally have engaged in sexual activities, knowing what she has done.
Because we still live together and because we still have had sexual intercourse since she admitted to the cheating, can adultery be used against her in court?
The only reason I continued to have sexual relations with her was because I was doing everything possible to fix our marriage. Clearly there is nothing I can do to fix it. I would like to know if i can file a case against my husband for declaring and producing a fake annulment. Its fake because i was never summoned to any family court nor receive any notice from the court. My wife and i have been estranged for almost 9 years now after she repeatedly stole stuff from me – my class ring and other jewelries i acquired since i was single and pawned them. She even sold our wedding rings! She also forged my signature (this happened 3x) to obtain large amounts of loans. I was the one holding our household finances after she “lost the money” or have the money “stolen” from her several times. I gave her monthly personal allowance (equivalent to her salary as a teacher which she was b4 giving birth to our son) so she could buy the things she wanted. I also opened an educational supply store for her when she refused to go back to work and suggested that she rather have such store, the income of which is hers alone. But it seemed that the income from the store and her allowance weren’t enough for she again forged my signature to obtain a loan amounting to 300k. When asked where all the money went, she refused to tell me. The store’s supplier also started to hound me for they werent paid by my wife at all. So i finally returned her back to her parents’ house and told her she could only come back to us (we have two children, who are left with me) if she confessed where all those money went. That was almost 9 years ago. She repeatedly attempted to come back but she refused to tell me about the money everytime and just asked me to forget about it and start over. Can i use these instances of “cheating”on me as bases? Also, do i have the right to sue her for forgery?

I Caught my wife communicating with her ex-boyfriend. It’s been quite a long time, their communication using messenger. I was not able to read the entirety of the messages since its very very long. On their conversation, she accused me of not providing for our Kids, which led the Ex to be Mad. The wife agreed (signed an agreement) because she is going abroad anyway but without knowing that the husband is already living in with his new girlfriend. When the wife knew that the husband is living in with his girlfriend, she changed her mind and would like to have the custody of their three children aged 9,8 and 6. Since the mother is going abroad, she decided to leave the three kids under the guardianship of her single older sister.
With the presented situation;

My boyfriend has a daughter dun sa ex girlfriend niya (ex live in partner). 3years ago naghiwalay sila dahil hindi sila magkasundo at lage nag aaway at madalas nauuwi sa bugbugan (nagbubugbugan sila at si girl nagbabasag daw ng gamit). Until 1time nababanggit na ng ex-live in partner ang pagsasampa ng kaso para sa bf ko (RA 9262) and para din daw sakin dahil alam ko daw na pamilyado na pero nakipagrelasyon pa rin ako. Gusto ko lang sana itanong, 1.) posible bang masampahan ung bf ko ng kaso kahit na nagpapadala naman siya 2k weekly? Hindi ba un kasya para sa expenses ng bata, kung equal sana ang share ng nanay at tatay, makakabuo ng 4k weekly. 2.) wala bang law para sa kahit sino (lalake man or babae) ang nagpoprotect sa mga taong nabablackmail or hinihingan ng mas malaking amount para sa anak or else sasampahan ng kaso kapag di nasunod ang gusto? 3.) posible din kaya talaga na masampahan din ako ng kaso for having a relationship with my bf na may anak nga pero hindi naman kasal, at sinusustentuhan naman ung anak nila? I hope i can get an immediate response about my concern. I am legally married with my wife for almost 8years. My wife went to Japan to study and eventually work there. However after 5 months i found out that she was cheating on me. I found that out through her FB account sending nude pictures to each other. So my girl “friend” lives with his live-in partner togther with her 2 kids and their daughter… His live-in partner found out that she was flirting with another guy ((workmate)) and had a one night with him.. Maribel, by way of general information, a subsisting marriage can only be declared void or annulled by a court. Until that happens, any subsequent marriage is void under Philippine law. Good luck.

mommmz, any accused has the same rights under the Constitution, laws and rules of procedure. For instance, all accused enjoy the presumption of innocence until proven guilty beyond reasonable doubt.

I crossed this discussion and it did qualify my curiosity. I have this known and strange scenario and is now questioning me. However, I would like to ask to what if’s in this situation. This is between Adultery and Bigamy. The mom of the said family acquire adultery in the first hand of marriage (no case yet) this is between multiple men brought at home that even live and known by the husbands family, neighbors and friends. And this does not stop her of commiting 4 mens sexual and intimate relationship that cause the husband move to a different country to pursue his dreams for the family given that he already known the situation. However, as part of the plab the wife (who commited adultery) will also join her husband, however, failed to due to multiple relationship she has. Now for a long years to said incident the husband long for fidelity and love marries a another woman on a different country said to be Bigamy. This acquires illegal marital status that they acquire to NSO and now has 2 kids. Now the question is will the wife be sue for adultery and the husband will have Bigamy (yes) and how the wife’s adultery affect the case they filed for Bigamy ( now) . WIll there be a chance the Bigamy will be lessen due to wife adultery and will there be a chance it will be dissolve? (Bigamy). Thanks

My opinión re adultery provisions based on my personal experience is purely theoretical and neatly printed in black & white, yet not stricly enforced and implemented. One may hire the best lawyer in the Philippines, in fact we have thousands of them with fresh minds and strong spirits but what really matters is the amount of bribe a petitioner or respondent can shell out before the court and it`s staff. I made it a point from the very beginning that I still believe in the Philippine judicial system and swore that I would never tolerate bribery.
I have already noticed irregularities in the administrative procedures starting from the fiscal’s office. A warrant of arrest came first before the fiscal resolution was delivered to my home address. My case was directly moved to the Metropolitan Trial Court. I questioned the court’s clerk about it, the only answer I got was a complete silence.
My lawyer had to act inmediately, he processed the bail while making arrangements with an old woman (around 60 yrs. Old), who acted as our negotiator with the RTC office. I even questioned my lawyer why do I have to pay 14K to a person whom I do not know and a non existing service. Ashamed of the fact just told me: it`s how it works in the Philippines. Eventually, we were asked to get inside the judge’s office, I’d rather called it as “palengke”. The staff were entertained with the TV show “wow wowee”, the rest were eating their lunch or snacks, one fat guy was loudly snoring while taking a nap. I was totally escandalized with what I have witnessed.
It was a lengthy trial, even to the extent of elevating the case to the Court of Appeals. We underwent mediation process and pre-trial stage. We agreed to withdraw the case against each other. Mine with him was Violation of women’s and children’s rights. Eventually, adultery case was dissolved after 2 years. I must admit that my ex is a psychologically imbalanced person. Uncontented with the decisión, he revived the case three months later such that we were prompted to elevate it at the Regional Trial Court citing it as a “double jeopardy”. Again, my appeal was dropped and learned from a reliable source that my ex must have paid around 500K. Again we filed a certiorari at the Court of Appeals in 2017 while RTC case was on-going and until at the present date no resolution from the Court of Appeal has transpired yet. Last year in 2019, we finally settled the case by paying off a discounted fee of 300K.
I hope my experience will serve as a reflection for those who are seeking justice because seeking for it is extremely costly. I would strongly advise everyone then to be prepared with the mental, social and financial stress that comes with it. I am just lucky that I am holding a foreign Passport such that I had the chance to flee from the country. It was the most difficult decisión I had to make: leave home, work, friends & my family.
Last year, I went back to the Philippines to file Reinforcement of Visitation Rights on Minor Child. Lately, the Regional Trial Court unfairly dismissed my case due to failure of the parties to compromise. I can’t define any kind words to the femle judge now except being TERRIBLE, UNFAIR, UNRELIABLE and INHUMANE. I have no plans of pushing further my case to the Court of Appeals as I find it useless, waste of money, effort and time.

Scenario: In 2014 the husband started to have an affair with another woman who is also married. After 2 years (2016) his wife had undergone a surgery and while on recovery state the husband left her to be with the the other woman. In 2018, the wife left their house due to much pain and to cope up with stress and depression. In 2020, the husband brought the other woman into their house with the knowledge of his parents and lived together, then, he lived filed for annulment.
The question is, can the wife file a charge as concubinage for her husband though the husband just started to file and annulment? Or is there anything can be file for charges though he filed annulment?
