There are a number of good reasons in favor of having and using a credit card. Still, we all know the possible adverse results in the unchecked use of “plastics” or credit cards, such as this one: “THERE’S a credit-card horror story that’s become some sort of an urban legend: A television personality, after losing his job in a top network, resorts to using his plastic money. By the time he finds employment in the rival network, he has wracked up P58,000 in credit card bills. But he figures he’s not yet ready to pay in full, so he pays just the minimum amount due. Yet after five years, he is shocked to realize that his credit card debt had ballooned more than 10 times to P700,000.”

Perhaps you’ve heard, or, most probably, experienced certain “innovative” strategies used by credit card companies and their collection agencies in “persuading” you to pay (they are, of course, entitled to payment). With the rising complaints against these strategies, the Bangko Sentral ng Pilipinas (BSP) issued a set of rules and regulations governing the credit card operations of banks and affiliate credit card companies.

As a rule, banks, subsidiary/affiliate credit card companies, collection agencies, counsels and other agents may resort to all reasonable and legally permissible means to collect amounts due them under the credit card agreement. However, in the exercise of their rights and performance of duties, they must observe good faith and reasonable conduct and refrain from engaging in unscrupulous or untoward acts. Without limiting the general application of the foregoing, the following are considered unfair collection practices

  • a) the use or threat of violence or other criminal means to harm the physical person, reputation, or property of any person.
  • b) the use of obscenities, insults, or profane language which amount to a criminal act or offense under applicable laws.
  • c) disclosure of the names of credit cardholders who allegedly refuse to pay debts, with certain exceptions.
  • d) threat to take any action that cannot legally be taken.
  • e) communicating or threat to communicate to any person credit information which is known to be false, including failure to communicate that a debt is being disputed.
  • f) any false representation or deceptive means to collect or attempt to collect any debt or to obtain information concerning a cardholder.
  • g) making contact at unreasonable/inconvenient times or hours which shall be defined as contact before 6:00 a.m. or after 10:00 p.m., unless the account is past due for more than sixty (60) days or the cardholder has given express permission or said times are the only reasonable or convenient opportunities for contact.

As a rule, banks, subsidiary/affiliate credit card companies, collection agencies, counsels and other agents may resort to all reasonable and legally permissible means to collect amounts due them under the credit card agreement. However, in the exercise of their rights and performance of duties, they must observe good faith and reasonable conduct and refrain from engaging in unscrupulous or untoward acts, including those enumerated above.

    If you can live without any credit card ever, don’t pay.
    First is to remove yourself from the net/online etc.
    Change your address, change work etc. You’ll be well off not paying. They can’t do you any physical harm… It’s only you harming yourself if you keep being ‘good’ to these suckers.

    Ask ko lang po if personal loan same with credit card.. Delinquent ako for almost 4months to this loan and the collection agency always tell me that if i will not pay, they will file a case in the court. Nakiusap ako if pwede staggard payment since tlagang nagkaroon kmi ng financial problems pero lalaki daw ang interest..then they told me also pupuntahan ako sa work at s bahay kasama ang mga kagawad at chairman daw.

    Ask ko lang… yung credit card ko lagi ako chinachargean ng finance fee kahit dko ginagamit tapos approve na un waived ko na walang finance charge pero tuloy pa rin sa pag charged.. sabi ko paputol ko na lang.. tapos sabi nila settle ko muna.. so binayaran ko.. den after sometime meron na nman.. ang sabi nila i have to go kun saan branch yun ako nag open para paputol ang alam ko laguna pa yun so sobrang layo na ng place saken.. tapos ayaw pa nila sabihin kung saan sa laguna.. pde ba ko mag file ng complaint aa kanila kasi dko nman ginagamit un credit card tapos ayaw nman nila paputol un line ko kahit tru call or email

    who here experiece calling from sillano law office due to aeon credit? the fact that it almost five months left unsettled for the appliances i’ve got (around 7k worth) and they did harrassment calling my office and threatening me to file a case against me, ang problema sa government ako . Napaka rude nila pag kausap o willing ka naman bayaran but not right now. after a year ago?

    same thing with me may nagtext sa akin na papadala sila ng DAccs and law firm agency sa bahay with bgy assistance daw for asaet checking.

    I’ve been experiencing the same forms of harrassment.. The Law firm specifically the CASES CHUN & ASSOCIATES LAW OFFICE has been calling me sa office at sa bahay. Bawal gumamit ng cp sa work ko while office hours kaya usually naka silent phone ko. I’ve advised them already regarding that matter pero tumatawag parin sila lalo sa bahay. Un lola ko lng ang nasa bahay pag may pasok ako. Knowing na matanda ang kausap nila nagsabi parin sila ng mga pagbabanta na ipapabarangay ako etc. etc. pati un details about s utang ko dnsclose dn nila. Napaka unprofessional nilang kausap.Kung makapag salita sila parang pera nila un inutang ko. tiniis ko un pero un pagbantaan nila ako na pinadaan pa sa lola ko un ang hndi ko matanggap. May heart condition ang lola ko, ng nakausap nya un s law office n un sobra syang nag panic. umiiyak na tumawag sa mother ko. Grabe tlga ang pang haharass nila. pati sa office kung ano ano cnsb sa officemates ko. Gustong gusto ko silang balikan pero hnd ko alam kung pano.

    Hi my gusto lng po sana akong itanong. My nakukulong po ba sa utang? Bale nagloan po ako sa isang online loan tapos after 69days hnd ko po nabayaran dhil that time gipit po tlg ako 3k lng nman po ung loan pero dhil my interest 4200 po ang amount. Nung last thursday po (sept6) my nareceive po akong call from their law firm sbe nya amounting 10k ndw po nees kong byaran tpos nung monday (sept10) tumawag na po taga PMC sakin my marereceive ndw po akong demand letter pra dw po sa hiring. Nung nag ask po ako if magkano po ung need kong bayaran naging 15k na dw po ayon sa atty na nakausap ko. Nakikiusap po ako sknla na bka pwede bigyan ako ng kht konti pang panahon para mabuo ang 15k. Ayaw po nlang pumayag gusto po nila oraMismo mabigay ko po ung buong 15k wala nman po akong nakikitang breakdown bkit naging 15k po sya. Ang sbe po saakin magbyad dw po muna ako kht half pra ipakita saakin ung breakdown ng utang ko. Kng di ko dw po mabbyaran agad ngyong araw harapin ko daw po ung kaso ko. 3k lng po yan nagsimula

    hi… ako naman naka recieved ng letter from telan stating na nagloan daw ako sa sa isang lending company at need ko na bayaran un… kaya lang hindi naman ako nagloloan sa kahit saang compny kahit kelan… ano kaya ang magandang gawin?

    Naranasan ko din ma delinquent sa card. I had 4 credit cards Metrobank (13K), RCBC (7k), BP (19K) at Eastwest (30-32k ata). Ginamit ko kasi sila sa pagproccess ng papers ko abroad. Pagdating abroad 3 months bago nakahanap ng work at makabawi ng konti. Anyways, I paid them monthly kahit mga tig 1-2k lang each. Then Metrobank RCBC monthly ang nasettle after after 8 months natapos din sila. Hindi pa naendorse sa collection agency sila. Nagkaroon ako ng sakit so I wasn’t able to work and yun savings ko napunta sa medical expenses. Late this year nakabawi na so so I settled BPI coz they keep sending emails. Yun BPI lumaki ng 30k pa pero binigyan nila ako ng discount na 23k payable in 3 months daw or 17k one time payment. Hindi ako nag-agree pero I paid mga 5k sa una. Then nag-email sila na narecived na daw nila yun at ano daw next plan ko sabi ko babayaran ko nalang yun remaining sa 12k pag-uwi in 2 weeks which I did. After a week nakareceived na ako ng clearance cert. Eastwest nalang ang problem ko dahil nagballon na siya ng 160k (almost 2 years unpaid na kasi). Nagalit pa sakin ang tatay ko kasi may LAST STAGE of EXTRA JUDICIAL COLLECTION sa letter na narecived niya. They gave me one time payment option and 2-3 months payable. Wala akong response like sa BPI kung ano lang kaya ko yun lang pinadadala ko pambayad. Basta don’t sign anything or agree to anything. Pay as much as you can. Mangungulit lang sila na kelan yun payment na susunod at ano ang plans mo pero just tell them you’ll pay what you can.

      ask ko lang pwede ba ako makakuha ng amnesty para bumaba ang pagbabayad ko ng credit card? ang remaining ko lang na balance eh 5k, umabot na daw xa ng 50k sabi ng sillano law office, at kailangan ko na daw bayaran un bago pa daw nila ibigay sa atty. nila to file a case… ano po ggwin ko? san ako kukuha agad2 ng 50k??? GUYS PAHELP NAMAN, HINDI AKO MAKACONCENTRATE SA TRABHO, LAGI AKO LUTANG DAHIL NAGIISIP AKO SAN AKO KUKUHA NG GANUN KALAKING PERA,
