Perhaps you’ve heard someone making threats to file criminal cases against debtors who fail to pay. On the other hand, perhaps you’ve heard about the rule that no one can be imprisoned simply because of a debt in the Philippines. The prohibition against imprisonment for a debt is a basic right enshrined in no less than the Philippine Constitution. Article III of the Constitution reads:
“No person shall be imprisoned for debt or non-payment of a poll tax.”
REASON FOR NON-IMPRISONMENT
The Supreme Court explained the rationale for this prohibition in the case of Lozano vs. Martinez:
. . . Viewed in its historical context, the constitutional prohibition against imprisonment for debt is a safeguard that evolved gradually during the early part of the nineteenth century in the various states of the American Union as a result of the people’s revulsion at the cruel and inhumane practice, sanctioned by common law, which permitted creditors to cause the incarceration of debtors who could not pay their debts. At common law, money judgments arising from actions for the recovery of a debt or for damages from breach of a contract could be enforced against the person or body of the debtor by writ of capias ad satisfaciendum. By means of this writ, a debtor could be seized and imprisoned at the instance of the creditor until he makes the satisfaction awarded. As a consequence of the popular ground swell against such a barbarous practice, provisions forbidding imprisonment for debt came to be generally enshrined in the constitutions of various states of the Union.
This humanitarian provision was transported to our shores by the Americans at the turn of the century and embodied in our organic laws. Later, our fundamental law outlawed not only imprisonment for debt, but also the infamous practice, native to our shore, of throwing people in jail for non-payment of the cedula or poll tax.
In other words, no one can be compelled to pay a debt under pain of criminal sanctions (estafa is a different matter). No one can be imprisoned for non-payment of debt. The remedy of the creditor is civil in nature.
Let’s examine some laws that were questioned, albeit unsuccessfully, on the ground that these laws violate the constitutional prohibition against non-imprisonment for debt.
BOUNCING CHECKS
Bouncing Checks Law (BP 22) does not punish the non-payment of an obligation. The law is not designed to coerce a debtor to pay his debt. The thrust of the law is to prohibit, under pain of penal sanctions, the making of worthless checks and putting them in circulation. Checks have become widely accepted as a medium of payment in trade and commerce, and if the confidence in checks is shaken, the usefulness of checks as currency substitutes would be greatly diminished. When the question was resolved in 1986, it had been reported that the approximate value of bouncing checks per day was close to 200 Million Pesos, thereafter averaging between P50 to P80 Million a day. (Lozano vs. Martinez)
TRUST RECEIPTS
The same argument was raised against the Trust Receipts Law (Presidential Decree No. 115). The passage of P.D. 115 is a declaration by the legislative authority that, as a matter of public policy, the failure of a person to turn over the proceeds of the sale of goods covered by a trust receipt (or to return said goods if not sold) is a public nuisance to be abated by the imposition of penal sanctions.
It punishes the dishonesty and abuse of confidence in the handling of money or goods to the prejudice of another. The law does not seek to enforce payment of a loan. (Tiomico vs. CA)
CREDIT CARDS
Under the Access Devices Regulation Act of 1998 (Republic Act No. 8484), anyone who obtains “money or anything of value through the use of an access device, with intent to defraud or with intent to gain and fleeing thereafter” is criminally liable.
R.A. 8484 provides for a presumption: a cardholder who abandons or surreptitiously leaves the place of employment, business or residence stated in his application or credit card, without informing the credit card company of the place where he could actually be found, if at the time of such abandonment or surreptitious leaving, the outstanding and unpaid balance is past due for at least 90 days and is more than P10,000, shall be prima facie presumed to have used his credit card with intent to defraud.” We are still waiting for the test case on this.
Hi. My father is a businessman who contracted debts in his name instead of through the company. Should he pass away before the debts are paid, what happens to the obligation should his estate prove insufficient? Will his debts automatically be assigned to us (his children)? No his debt wii not be assigned to you but will be extinguish by reason of death.
Hello, would like to ask my mother passed away and still had debt with the bank. Before that she was ill and didnt pay the debt so the bank let her signed a compromise agreement. She died last January and now the bank was seeking payments with me as her daughter including with the co-makers. Am i reliable to pay and so the co-makers? Please reply i will appreciate it.

The co-maker may be forced/obliged to pay if he/she actually signed a legal documents but not you just being a daughter.
my father died in 2005 and one of his friend asked for a payment thru an annotation written below the tax declaration document. the annotation asking for payment has no document as evidence for a debt even he (friend) admitted that he has no document supporting such a debt. now we are being harassed with this guy. what will we do to put a stop and end of his foolishness?

Is their a law which stipulates that a permanent instructor in a State Colleges and Universities who have not finished their masteral degree will be downgraded to a temporary or probationary instructor?
we had a small business early this year but due to my husbands health condition we stopped and so a friend took over letting her use the entire place and all the things inside. after her three months of operation we decided to pull out our things so we asked for clearance from the lessor if can pull out our things. the lessor approved and so we moved out. this friend sued us for a month ” accrued rental” when in fact we were already cleared by the lessor. she filed a case at the barangay level. does she has the basis for doing so?

Right. I guess that constitutional provision is one of the most misunderstood provision. But on the other hand, The loan business industry in the country is a loose one. So in reality, a lot of people do not go to court to settle their debt. Most loans are incurred via the “5-6” system anyway.

Same thing happened to me. My husband borrowed P35,000 from a Lending Company to pay for his placement and processing fee to the recruitment agency. Unfortunately, the company was not able to give salaries on time since he was deployed there last April 30, 2015. Now, the Lending Company personnel and their legal staff whose names are just nicknames and they dont give e their full name when I ask them who they are. They are threatening me that they will file a BP 22 estafa case against me since I am the co-borrower and co-signatory for the account. I know that I have to pay and willing to pay but I am requesting them to give me consideration to restructure my account and pay it in 6 months term. They are forcing me to pay P10,000 on or before March 31, 2016. But I pleaded to make the payment on April 15, 2016 because I still need to look fot the P10,000.00. I am so much bothered now, cant sleep and cant eat well because of what they are doing. They are also calling and texting my reference contact persons and giving me shame in this situation telling them they are not able to contact me. Please help me and any advise in my case. Nitong marso hanggang hunyo medyo nahirapan lang talaga, pero naka bayad kami ng limang libo sa kanila at natira yun mahigit isang libo na interest daw yun sa limang libo.
Ngayon sinabi na namin na magbabayad kami bago matapos itong buwan ng hunyo, pero napakasama ng mga salita na binitawan samin ng collection agency sa telepono, keso sasampahan daw kami ng kaso na breach of contract; ipapapublish daw nila ang pangalan namin at marami pang ma-aanghang salita. Alam namin na nahuli itong pang huling at final na bayad pero sa ulit, nakapagbayad din ng mahigit sa kalahati na hinihingi nila. Tama ba itong ginagawa ng collection agency at kung hindi, saan kami puede dumog para makapag-reklamo.

If the so-called “law office” or collection agency proposed options for payment, pero hindi mo pa rin kaya yung payment options na binigay nila tapos you proposed the amount na kaya mo ihulog sa kanila monthly, can they still pursue litigation? I owe a certain bank payment for a salary loan. I understand what the blog said about not being imprisoned but what about taking of properties? I saw from the link that you quoted the bill of rights to support this. However, the latter mentions, “… no one can be deprived of life, liberty, property without due process..” or something like that.
Question is, can they really take properties even if they are willing to go through all the legal proceedings? What can we do, too, as consumers who have somehow taken steps to pay but just cant pay the full amount due to sudden changes in circumstances that affected our capability to pay?

i just wanted to know the best and legal way for me to get the money that was borrowed to me by an OFW who is based in S. Korea. I have been promised countless times and even sent me a copy of her drivers license, alien reg card and a promise to pay letter but with no good results.
I know that no one gets imprisoned because of debt, but would it be possible to have that person deported from S. Korea for non-payment of debt?

I have an outstanding loan from a Financing Company. This is my second time to avail of their loan services, but due to some unavoidable circumstances I failed to pay all the monthly amortizations via PDCs I have issued to the company. Thus, I was informed that a BP 22 case has been filed against me. I haven’t received any subpoena or warrant from the court since I moved to another residence. Mails concerning my outstanding loan from the financing company were either directed to my mother’s residence or to my husband’s office mostly threats that they would be publishing my picture on the newspaper. Just recently, a letter was delivered at my mom’s residence stating that should I fail to make arrangements with their office within a week upon delivery of the letter, they would be posting my picture in two leading newspapers for four consecutive weeks (a sample for said notice re: pending BP 22 case with my picture has been attached). Is this really possible? And if a case has been filed against me, should I not make arrangements with them in court and not in their office? I really need your advice on this.

I was required to issue post dated checks before I was granted a personal loan by a bank. After some payments made, I started defaulting not by intention but because I no longer have sufficient financial capacity to pay at that certain time and the PDCs I made started bouncing, can I be charged with Estafa or BP 22 and imprisoned?

I want to go to law school; however, i realized that it will be useless since I discovered that I have an outstanding balance with a credit card company. I used to pay it 6 years ago, but when i noticed that my payment has not been deducted in a monthly period I communicated with the bank and I was threatened and being compelled to pay the remaining balance. Anyway, I stopped paying but I haven’t received any call or mail from them given that I did not change my address. Nonetheless, when I was about to obtain a car loan from a different bank I was denied due to the fact that they discovered that I have an outstanding balance of more than 100 K.
My question is, just in case, i finish law school and pass the bar will the SC allow me to take my oath? What will be your advice?

I understood (from the link you provided) that the estate is the only recourse of creditors against debtors that have passed away. If this is insufficient, could the creditors legally have basis to go after the children and demand payment?

Hi. My father has been dead for 5 years now. He died last 2006. Just recently, we received a letter, addressed to my father, from a bank informing us that my dad has unsettled loan from the bank. The bank even sent a representative to personally deliver the letter to us. We were surprised about this as we are unaware of the said loan. Will this debt be automatically assigned to us? My father has a big debt to one store. He got couples of truck wheels in the store but not able to pay them. And his other wife was the one who signed all the receipts and documents. But now, my father can’t pay the said store, and they can’t get any from his other wife, they went to us. They are looking for our father and threatening us. May gusto po sana akong ikunsulta sa inyo and I know your the right person can give me the best answer for my problem.
I used my HSBC credit card for almost 1 and 1/2 year. I continue using it by purchasing and paying all the bills with interest. Suddenly December 2011 when im purchasing one of the prestigious department store hindi daw magamit yung card ko. When I called at the costumer service of HSBC temporary hold daw I need to submit the documents which is ITR, Certificate of Employment and 2 months latest payslip. When I submitted all the requirements they said please wait for 24 hrs. Then after that I called again. They said “wala pa daw result call back within 3-5 banking days”. When I called again they said “wala padin daw result, so call again by 2-3 banking days.” and so on…. Until today March 26, 2012, wala padin result yung card ko but im continuing paying the minimum due every month but i cant use my card. Before they cut or hold my card I paid the amount of Php 8,000.00. After I paid that amount they hold my card with no valid reason, they did not inform me why they hold my card even notice or letter wala akong na-receive basta nalang nila hi-nold ng walang pasabi saken. Siguro 10 costumer service na yung nakausap ko na laging ganon ang sinasabi saken actually I listed all their names.
Ano po ba ang dapat kong gawin? Kasi para pong paulit ulit nalang na ganon ang sinasabi nila. nagbabayad po ako ng maayos kaya bakit ganon ang ginagawa nila saken.

I have a FRIEND who used to have GLOBE text PLAN. He was not able to settle his account which reached to the point his plan is cut. He has a total bill of Php 4,500.00 for 8 months + Php 7,000.00 breaching of contract fee.

May credit card me at nakakapag bayad me above the minimum amount due ang problem po na nakawan me nung May at since nun hindi na ako nakapag bayad ang credit limit ko ay 15k lng pero 45k mahigit na sinisingil nila willing naman mag bayad po. I have a question about a bill that was sent to me by a postpaid telecommunication that reached 649.000 pesos or more. As I read on the bill, it was the time that I went to Hong Kong for a vacation. My phone was just turned on when I went there without knowing that my roaming feature was on. After 2 months, they sent me a bill with that amount. I told them that the phone never had any notification that my roaming feature was on. With that, I just let my mobile internet to stay activated since it was part of the plan that I enrolled in (unlimited surfing). This was very unfair on my end. Honestly, I can’t pay this amount since I am not earning as much as this amount. I am even the one sending my sister to school leaving me with just enough money for my needs at home and at work. So, my question is, will I be sued and imprisoned because of this? Can I file a complain against this company to court for this is very unfair on my end. The phone did not give me any notification that my roaming feature was already on and this is the first time that I used a postpaid plan. Please help because this really makes me worry everyday. This is one of the reasons why I am thinner now because I keep thinking about it.

Hi, nangutang po ako ng 20k nung January 2011 na ang nakaprenda eh yung payroll atm namin, ang binigay sa akin e 16,500, kasi kinaltas na nila yung tubo which is 18% payable in 3 months. so ang hulog ko eh 3,333 kada sahod kinsenas-katapusan. Nakapaghulog ako nung una, pero natanggal po ako sa trabaho, tapos di ako nakapaghulog ng pangalawa, pangatlo….ang hulog ko po uli e nung panganim na hulog na dapat na 3,333, so 4 ang di ko nahulugan. Kaya lang nabuntis po ako at tumigil sa trabaho, so tumubo po ng tumubo yun. hanngang sa maging 15k, nakipagayos ako at naghulog ako ng 5,500 tapos 3,500 uli. pero nagsara yung pinasukan ko, so tigil uli ako..tapos tumubo na naman, hanggang sa maging 23k na daw, naghulog uli ako, at nung huli ay 7000 nung february, kasi sinurrnder ko uli yung atm ko..kaso laging matagal bago ko makuha yung sukli sa sahod ko kasi nasa kanila yung atm ko. Bale lahat ng nahulog ko eh 22,500 lahat, yun nga lang tumagal ng 1 taon at kalahati kasi patigil tigil. Nung hindi na ko makabayad, sinampa nila direkta sa judge at pinadalhan ako ng notice of hearing, pero dun kami sa harap mismo ng judge magusap daw. ang sabi ko hulugan ko pero sana tigil na yung tubo kasi nabayaran ko na nman yung 22k. My employer asked me to sign an agreement, and asked me to pay a penalty of 5000 pesos for referring our applicants to other company not related to us for them to secure their visa.
The nature of my employer’s business is consultancy, I referred our clients to an insurance company.
And now since they did not get commission on that, they are asking me to pay 5000 as a penalty because according to them I violated the company rules by not telling it to them. But I believe, that referral has nothing to do with our operations, that’s why.
There were no any agreement between my company and the insurance company.
What should I do? I already signed the agreement because I had no choice, if I don’t I will be terminated, and that money will be deducted from my salary.
And now I am thinking of resigning or making an AWOL because of that.
It is with great regret that I signed that letter.
Will I be sued because of that? If I made an awol without settling the 5k?
I do not know, I am confused.

My Filipino fiancee’ borrowed a car from a friend to provide transportation in Cebu. She hit a little boy and killed him as he ran across the street. The family of the boy has asked for $3000.00 USD for burial, and compensation.
My fiancee’ is working at a call center as a trainee, and the company is threatening to dismiss her if she does not make restitution to the family, and the family is threatening to have her placed in jail.
I do not trust what she has to say, and she will not provide me a copy of the police report, and in addition she would not even tell me where the police station was so that I could pick her up.
I do not believe that she is truthful with me in any regard.

Ngaun po, dahil po hnd ko pa alam san galing at san pumunta ung 20k, hnd ko na po sinurrender ung bagong atm ko sa kanila. Hnd ko n rn po nabayaran ung utang ko dalawang taon na. Tapos nagsend po sila last week ng april ng demand letter to pay the amount with the interests. Within 5 days daw po or else they will take legal actions daw.
Aalis po ako ng bansa this week, magwowork for 6 months abroad padala ng company. Tanong ko lang po, kung magsasampa po ba sila ng kaso eh criminal po ba un at may karapatan po ba silang magpaissue ng HDO sa immigration?

i bought a motorcycle thru financing up to 3yrs from a motorcycle company located at espana manila.
the first year the branch closed without informing me. i tried to inquire at SM san lazaro manila if its possible to pay my loan at thier branch, they said yes i may, so the whole year i paid my loan at that branch.
the problem is, that branch moved again without informing us. i don’t know where am i supposed to pay my loan. i decided to check if i can get my certificate of registration from the LTO, fortunately i was able to get it. is it lawful if i will no longer pay for my loan. do i have a case if i will they will demand for payment and other interests because of non payment or take my motorcycle?

what happens if i am not able to settle my account with Globe.
I had the line cut to stop the amount due from increasing since last December from 12000 it went up to 32k even though line was already inactive.
i made several calls to Globe to dispute some calls i didnt make and also to downgrade my plan which they failed to do so from the beginning.
Some of the representatives even advised not to pay first until dispute was settled.
I made payments but not every month.
To make it short, Globe transferred me to a collecting agency and they started to harrass me by calling my house and telling me to pay as soon as possible to them up to 2 installments only as they called themselves attorneys.
my question is- can i be jailed for not paying what I owe because i dont have the money and i also
went to Globe business office to inform them about my situation and still they transferred my account to the legal.

I think that the weight of loans including cash loans, and salary loans depends on the customers capability to pay it back when and how.
we all agree to the idea that our country is not a rich country. In fact the people living in it are not even satisfied in just having a home and a job because the salary is not enough to raise a family at it’s best. As a result of this, there are a lot of emerging companies and establishments which offer Cash loans and other personal loans. Some says it just brings you down even more as it turns into debt but some says it is a last resort when it comes to difficult times.

Hi! My daughter is studying in San Beda and I got a letter from the school after a year that my daughter has Failed subjects, I talked and clarified the issue to Vice-Dean and it turned out that the said Prof. gave a failed grade due to absences. My daughter got sick and need to be confined due to Chikungunya that’s why she has consumed allotted absences, she submitted her med. cert upon returning to class but the Prof shrugged it off. She continued going to class even took and passed Final exam and has grade of 2.5 to which the Prof didn’t put it into a record. Upon confirmation the Vice Dean and Prof. agreed and assured me that the said grade will be given to my daughter and advised us to drop the same class which my daughter re-enrolled thinking she was failed.
The tuition fee for the re-enrolled subject were not refunded to us it’s in their school rule that a dropped class is not entitled to refund, even if it’s not our fault but their Professor. Albeit, we didn’t argue since it has been taking much of our time going back and forth to school and we valued their decision to give my daughter her 2.5 grade. However, until today (July 3, 2015) a year ago the said grade still not in effect.

Also, what can you say about “Notice” of payment, I got a letter of payment advice from them yesterday and need to pay the “Special Class Internship” in full tomorrow. Because ita way back 2015.. i loaned money to a person in exchange of my atm where my salary goes through.. i was able to pay some of it but i when i was terminated i had a balance still of 10k i think.. i wasnt able to pay it.. few years passed already. When i came back from dubai because i got pregnant she suddenly decided to ask the money back from me.. as far as i remembered i didnt sign anything.. but im not sure.. is there a case after all this years? Or what will happen? Or can she file a case on me?

Hi. I really need HELP. My father borrowed a money from a certain bank last 1999. A year after, were halfway of our debt (leaving our balance 5k) the bank declared its bankruptcy, thus it closes & we were not informed where to pay forward our debts.
Just recently my papa was called in the barangay council, since the manager of the new bank who took over the bank (creditor) ask us to pay them together with the interest & other fees, costing all in all 28k.
Note..we did not receive any notifications from them.

I need some advice. My mother borrow P70,000 in our neighbor last April 2015. The term is my mom should be paying 10% interest each month. But due to circumstances, my father and brother lose their job, my mom failed to pay interest in July and August. The same principal amount were not settled nor lessen. On Sept 2015, my mom gave our neighbor P4,000 only because of our financial problem. This month of December, whenever she come to our house, she wont enter and she will be talking to my mom outside while there are some people chitchatting there. I have been a victim of investment scam in Naga City wherein I borrowed a money from my 4 credit cards with total of 400,000. These banks already called me since I can’t no longer pay my debt and are already 3 mos. due. I applied for loan from 3 banks (Metrobank, Citibank,Eastwestbank) and made another cash advance withdrawal from my another eastwestbank credit card amounting to 69,000. I was attracted by its offers which only charge .99% interest per month.
I made a loan from these banks and invested the money to a certain person with a return of investment of 6% per month. After few months, they stopped their operation leaving me in debt. Those banks already filed for default and obliging me to pay now in full those money i have borrowed.
I have no money to pay them. I’m afraid they might file a lawsuit against me. What charges they might file against me?
I’m earning 10,400 a month with my present job. My wife is about to give birth to my child. How am i going to pay them? Will i go to jail because of this? What will happen to me? I can’t afford to pay for attorney’s fee.

My last payment was 10months ago and I have not given any follow up payment. The third party of the bank is calling and texting me regarding my dues. Some calls I have entertained and some have not. My work requires full attention and if I may say is loaded. I have tried returning their call lately as I wanted to settle this already but wanted to pay only what is due and not with correaponding of interests. Yet now, I have received threats that I will be escorted from my work office by policemen or whatsoever and is requesting for me to file for temporary restraining order.

I have a loan for a samsung s6 edge and it was very unfortunate that I lost my job and wasnt able to pay the loan (current debt is 27k), I signed a letter before that i will pay on a certain date, I did pay but it wasn’t for the full amount. Now someone talked to me and said I have a warrant because of that. Prior to that call, I already asked the company asking for arrangement given my current financial situation but they did not acknowledge. Now the lawyer sent me an email stating that I need to pay the full amount of 2k until feb 29th otherwise, I will be arrested.

My father has been arrested upon the demands of a credit Union for running delinquent on his loan. He faced a downturn in events some years back and took the loan to invest thinking it was going to go well. it did not. Now he has been arrested and a request that he pays a sum of about $15000 (that is the amount if converted from my country currency). This amount has risen Twice as much because of interest.
They request about $10.000 before he is released if not he shall be sent to jail awaiting trial.

One year to pay po yung utang which is equivalent to 12 barcodes we need to pay in Taiwan. Kaya lang napauwi po maaga at 5 months lang po yung nabayaran ko so my remaining pa po na 7 barcodes. Pinuntahan ko po yung lending company before going home sa Davao para mapagusapan po kung papano at mgkano yung bayarin. Hi sir, gusto ko lang po sanang humingi ng advice. Ganito po kasi ngyari. Nakautang mama ko sa isang matanda last 1995, namatay din yung matanda in 1995. Unfortunately pati yung asawa ng matanda namatay na rin. Pero bago sya namatay, nabayaran na nya yung utang, buong buo. Ang last payment ng mama ko ay 35k. Kaso wala kming proof na nabayaran yung utang. Pero during that time, nakita ko na inabot ng mama ko ang bayad. I was 14-15 y/o during that time. Ang naging collateral ay bahay at lupa (hindi yung lupang kitatitirikan ng bahay namin). Ang mali ng mama ko, di sya humingi ng resibo or katibayan na binayaran ng buo.
Eto ngyn ang problema, after so many years, hinahabol na ngyn ng mga anak nung matanda yung bayad ng mama ko, ang gusto nila bayaran sila ng outright 50k and 5k a month for 60 months, as kabayaran daw na kmi ay umuupa sa bahay.
Yung tax declaration, without knowing, natrasfer na sa pangalan ng matanda nung 2014, pero this is without our consent, wala nga ring kming pirma doon, I don’t know kung paano nila natransfer yung pangalan ng ama nila.

Naguluhan na po ako sa problema ko, regarding sa motorcycle na inutang ko sa isang financing, the contract ends march 23, 2016, pero may 8 months pa akong hindi nabayaran plus penalty to sum up 25k+ lahat. I have a question. I’ve been informing by my debtor to file a case against me even if I am still paying my loan. Although not able to pay the exact amount as stated in the contract but I am continuously paying an amount until I able to pay in full. Although, penalties and charges are huge amount, but my point is I would like to prove that I am still willing to pay and there are active payments in my loan account.

An incident happened to my 3rd daughter way back 2013 at that time she was 2 years old. I needed money so I can have her checked by a specialist. So I opted to borrow money from a lending company here at my province. I used the money to have my baby checked and pay the bills as well as purchase her medicines.Original amount is 40,000.00 Php and they took my ATM as collateral.The lending company directly withdrew my salary and give me the remaining money left after they deduct my loan payment.
Everything was going well until I got sick.I wasn’t able to pay since I lost my job. I was jobless for many months and then was lucky to be hired again but needed to quit since no one can tend to my babies.I got several different jobs but only lasted for 3 – 4 months since I needed to take care of my babies. I was transferring from one company to the other. Then jobless again.
Unfortunately I got pregnant on my fourth kid. The pregnancy was rough since I need to deliver the baby through forceps delivery October of 2014.I was again jobless. When my baby was 4 months old I applied and got hired in early month of 2015,however I quit the job since I will be assigned in Manila. Then I tried to apply in other centers, I got hired but quit after a few months since I got sick and diagnosed for TOXIC GOITER and GALL STONES.I didn’t give up instead I applied again and was hired February of 2016 however I was not expecting that I was again pregnant for my fifth child.My OB advised me to stay bed rest to avoid miscarriage so I again resigned.I quit from my job July 2016.
Then I gave birth to a premature baby girl August of 2016.Which until now don’t have a birth certificate since I have an existing unpaid hospital bill.Being the breed winner I need to work.After a month I then try to look for a job to sustain my families needs.Luckily I was hired last September 2016 but my salary was not enough to support my family. I was earning 4,000.00 Php per pay out 15 and 30 of each month minus the SSS,Pag-ibig and TAX. I stayed with the company from September 2016 until January of 2017. When the company declared bankruptcy and need to let go some of their employees since I was not a regular employee so I was one of the few who were asked to stop. I was again jobless and now March of 2017 I was hired and currently working with a salary of 10,000.00 Php monthly excluding taxes and government mandated deductions.
I was shocked when my salary loan turned out to be over 300,000.00 Php now and I am bothered and worry. I need an advice also. I borrowed Php14,000.00 from a lending company last year around May. Then failed to pay my debt since August as I had undergone breast operation. The lending company keeps on calling my sister until October and that is also the last month that I received an email reminder/billing from the said lending company. Then last month my aunt call me to inform that someone is looking for me due to my loan. My aunt don’t know who it was as she said that person didn’t say much aside from I owe them money. Then suddenly this Tuesday my aunt calls me again telling that a certai/ attorney had come and gave a warning letter that I only have until Wednesday to pay for Php26,816. That atty told her that she will bring the cops on Wednesday if I failed to paid for it. Then Wednesday I called that atty and ask for an extention so I could pay and if we can agreed on terms but then she just laugh and insulted me telling me I don’t have a sense of urgency. Since I don’t have monwy on hand I’ve ask her if I can just give a downpayment of 1000.00. We agreed that I will pay 1000 that day. My aunt called again and she said that a certain cop or chief of police called her and tell her that they will arrest her and imprison her that day because of my debt. Btw, I’m leaving with my aunt last year so I’ve used her address. My aunt is mentally unstable so I was also afraid that something might happens to her because of that rude atty and cop harrassment. I paid for the 1000 that Wednesday and I’m currently waiting for an email from the lending company since Thursday as I have requested for the breakdown of my billing but to no avail until now. I’ve also requested that same copy from the atty but to no avail. This morning a certain girl called me asking for the status of my payment as she was ordered by the atty. I’ve ask again for the copy but 2 hours had past now I haven’t receive it. If there is an Attorney Fee of Php5000.00 in the billing, can I refuse to pay for it and just pay for the 21,618 instead? I’m not the one who hired an atty so why would I pay that? Also that atty had beennothing but rude when she talks to me over the phone and with my aunt. Lastly the harrass my aunt and I think that is reason enough not to pay for the 5000 atty fee written in the contract. Kindly advise if it is possible to decline on the atty fee.

I loaned money from a loaning company and I wasn’t able to pay the remaining 2k last year and the interests gone up now for almost 32k. Now, the law firm called me to settle the payment and if I won’t be able to pay it it would be consider as a estafa. But I’m not hiding from them and they where able top contact me on my number. Will I go to the prison or to the court? What would be the sanctions.

Can or How to sue PLDT?
They wrongly installed the Home DSL i applied to some other people’s home. After multiple complaints, they transfer the unit from my address (in the application) to my current address, which is the SAME. Then they charge me for the wifi service that I didnt use from the period they wrongly installed. Complaints are made, and the issue still not yet solved. Every month I need to go to PLDT to explain the whole story over and over, and they just push the balance that they wanted me to pay to the next month.
Can I cancel my services despite in the contract it bounds me for a year of service? They breached the contract when they provide bad services to me.
Please advise.

Ngayong 2017 binigyan ako ng sulat, final demand letter daw tas umabot na siya 17000, akala ko tapos na noon kase hindi naman sila nagnotice noon sana habang maaga pa. Ngayon umabot na ganun kalaki. I would very much appreciate your advice on my financial problem. I was a previously working as an OFW for 7 years, pero I am back here na sa Pinas working in a contact center since July 2016. I currently have accumulated a credit card debt of 280+ thousand. My wife left the country last year to work as well to help our finances and support the family as well. The problem now is she is also back home due to visa issues when she returned for her vacation, she was no longer allowed to go back. I was able to make ends meet only paying the minimum amount due averaging to 15000 pesos a month for more than a year now, but I won’t be able to continue this since I am now the only 1 working to support the family. You may be wondering how I was able to accumulate this large amount of debt. Me my wife have made very poor choices in handling our finances when I was still working abroad, one of the many OFW failure stories.
Sana po may makapag advise kung anu po yun pinaka maganda na gawin ko for the moment. Wala po akong plano na takbuhan yun utang ko, pero sa ngayon, mas uunahin ko na suportahan ang pamilya ko kesa bayaran yun minimum amount due na more or less 15000k a month.

The day after ma deposit ung loan s atm ko is pina CANCELLED ko xa thru email.. Kasi po ung ATM ko is nkasanla then sabi ko sa pinagsanlaan ko is hihiramin q muna ung ATM ko para ma withdraw q kung loan q sa Doctor cash but unfortunately di na nagpakita sken ung pinagsanlaan q the day before ma deposit ung pera.. Kaya agad agad ko xa pina Cancelled then afternoon sabi ng Doctor na na deposit na daw ung pera. Sabi q po hindi ko nakuha ung pera at pina cancelled ko n yun bago pa nila ma deposit. Pero they still keep me want to pay for that and after 1 month umabot n xa ng 30k.. And after 1 week may collecting agency n tumatawag sken at harrasssed na they going to file a BENCH WARRANT at ppunta daw sila s bahay kasama ang sheriff para i check daw ung property q at sumama nlang daw po aq ng maayos s pulis to avoid comotion daw.. I have a personal loan with “DR. Cash” amounting to Php 4000 and I receive a proceed of Php 3600 because they deducted Php 400 for interest. Yesterday they are asking me Php 15,000 to settle this so that they will not push the case. I was only able to pay Php 8000 and they ask for the remaining Php 7000.

Hi! My wife fails to pay her borrowed money from private individuals in Israel. Because she wanted to finish her borrowed money obligations here in the Philippines she did not hesitate to borrow money there even with very high interest. She missed to monitor it until her salary can no longer enough to pay the interest. Those individuals force her to pay, threatened and throwing words that are so degrading. These gave her a great stress that she can’t concentrate anymore working.

My father loaned an amount (60k) so he can go abroad last 2010.
Apparently, he encountered issues and thus not been able to send money for us and furthermore, he also had debts to pay just to survive.
Every now and then the bank and collecting agency sends us demand letters and now (it reached more than 500k- just because of interest. I know we do not have any amount to pay, if the bank will have an amnesty program to just let us pay the 60k, we can work for it.
It is just last year, that he was able to bounce back and started to send us money. We were able to pay our house worth 200k which was an acquired asset. Now the house is name after my mom.
Will the bank asks my mom (house wife) or us to pay for his debts and will get the house? (not sure if the house is collateral or not?

Good day! I am a public school teacher and I need your legal advise. My ATM was loaned to a lending institution- salary loan. Last November, my year end BONUS and CASH gift they had withdrawn was not given to me because it was made to pay for a separate loan that I have with them which will mature on MAY 2018. My bonus and cash gift were not committed to any of my outstanding obligation, and I requested that such must be released to me. They never did. In my frustration and anger over what they did, I declared my ATM lost and had it replaced. I did it because our PBB and other incentive is about to be released and I fear that once withdrawn, said lending institution will do the same with my bonus and cash gift, meaning they will not give it to me and will use this to pay for my salary loan, which incidentally is paid regularly through payroll deduction. Because of this, the manager of the lending institution filed an administrative case against me at the Department of Education in our Division. Is her action justifiable? Is this not a form of coercion on the part of the lending institution? I am a solo parent with 3 children and 2 grandchildren. Hi I have a loan from Doctor Cash or Moola Lending (online) loan. I actually borrowed 2,000 pesos and i agreed to settle it installment however, in my last installment period i forgot to pay the remaining 600 pesos and automatically it goes to 2,500 again so what i did i just pay again the 600. But the Since, i got financial problem. I wasnt able to settle it and after 1 year and it goes to 11,000 already and there was a collector keep on calling me and telling me to pay 2,200 to settle my account. Good Day! I would like to ask an advice with regards PJH Lending Company. I have borrowed 50k from them as principal and the interest is 32k payable within 10 mos way back Oct 2015. They have given me an amount of 7,9 monthly but failed to comply but I didnt miss to give not less than 2k per month since i am paying 2 lending companies to be honest. Until now I am still not finished because they says I havent finished paying the principal and penalties as yet. I am asking for SOA but they dont mind giving me. But because alam nmin na halos interes nlng ung binabaydan nmin sa knila nag li lo na kmi nang pagbabayad. And until ngaun, sinisingil pa din nila kmi dun sa 39k na balanse daw nmin. Nakikipag matigasan kmi kc sobrang sobra naman na ang moral damages na nadulot nila sa amin. Ngaun n kahit medyo kaya na nmin magbayad dahil may maganda na kong trabaho e sumasagi sa isip ko na wag nlng dahil besides sa madami ndin kmi naubos na pera kababayad sa knila e kung ano ano pang banta ang naririnig namin sa kanila. Ano po maaadvice ninyo sa akin about po dito.

My wife and a certain couple both government employee agreed to be a business partner . lending money to interested persons with 5% interest ..my wife got the money from the couple and lend it to interested persons with 6% interest. For the first year of the said business was ok ,but comes a time that the debtor failed to pay and some others moved somewhere without leaving their whereabouts ..for this reason the couple went to our house with a written contract that our small house and lot serve as a collateral including improvements etc. we affixed our signature because the couple gave us assurance that they are not interested of the property . We were force to shoulder the payment for the fear that our small property will be sequestered and the couple started harassing my family when sometimes we cannot give some payments due to incapacity. Hi my husband contracted a personal loan of Php 100000 in february of 2015 from chinatrust bank and issued checks for 36 months amounting to Php 4467/month . Everything went smoothly until he changed his phone number early this year. He didn’t know he had problems with the bank that he issued checks for chinatrust since he changed his number. Thus his remaining 3 checks issued for chinatrust were returned and payment did not push thru. Furthermore, he has left his old house already for 2 years since we transferred to a new house thus he has not been receiving any notice from chinatrust since he issued the post dated checks. Around march 2018 he received an email from a collecting agent of chinatrust that he has to pay Php 13435 for his remaining balance which we obliged to pay and even gave his new cellphone number. Then later in April he was called again by the said agent saying that he has to settle an amount of Php 12000 something to settle his account. My husband already refused to pay such amount since it’s too much for an interest. Can the bank still file a case against my husband?

And usually the collectors is the one who goes to our house and collects payments. And in year 2012 they suddenly stop collecting payments and their office is closed. Now after 6 years of no contacts they have sent a letter to my mama this june 2018 and they are telling my mama to settle her account. Is their any cased will be filed if my mama can’t pay or settle this account of her? Both my papa and mama is now a senior citizen and no capabilities to pay because they have no pension.

Hi I have borrowed 7k from an online lending. They only disbursed 6k to my bank account because of some deductions like service fee etc. Then they told me I will paying P9100 for my 7k loan.

hello. i am being hunted by a collection agency due to my past loan with a bank. The only mode of payment of that loan is issuance of check under the bank’s name. I wasnt able to fully pay my accountabilities and back then and now they have found me again, i am being forced to pay a. P300k in one year, b.P100k in one month or c. P80k before the end of the month. I’ve been meaning to pay this but the payment terms are quite unreasonable. Note that i only borrowed 50k and was able to pay at least half of that thru monthly amortization. They are now harassing me and telling me i will get imprisoned due to estafa (bouncing check law). Is this really possible? What if i would agree to settle but on more lenient payment terms, will i still be imprisoned? anyone please help.

Pero pagka June 30 may isang ahente na tumawag sa akin ng offer ng CAsh loan na Five thousand Pesos(5,000) payable siya within one month.Pero after 30 days seven thousand(7,000)daw yung babayaran ko. So sa laki ng interest at hindi ko naman kailangan ng pera non sinabihan ko ang ahente na tumawag sa akin na hindi ako mag aavail kasi hindi ko nmn kailangan ng pera. Pero kahapon po may na received akong text from CASHWAGON na mg file daw sila ng LEGAL DEMAND PAG hindi ko po nabayaran ang utang ko.Ng chinik ko po yung atm ko may nag sent nga po na 5,000 sa atm ko noon July 1.

Of their rudeness I borrowed 5 thou and I was delayed for a day and Asked them to payfor extension fee because I am not yet paid but the collector threatened me that. I was very annoyed because for only one day they talk like shit.. while other lending talk nicely. And gave options and 7 days grace period. So I was. Challenged and. Told them to sue me. And I will see them in court.. they called. Many times but I ignored them and. Later. Send me options. That. I was given a discount promo but I told them that I would want to meet that lady collector so Im waiting for that subpoena but until now I didnt recieve any notice.
