Theft cannot have a frustrated stage, according to the Supreme Court in a recent case. Theft can only be attempted or consummated.
According to the SC, unlawful taking is deemed complete from the moment the offender gains possession of the thing, even if he has no opportunity to dispose of the same. Unlawful taking, which is the deprivation of one’s personal property, is the element which produces the felony in its consummated stage. At the same time, without unlawful taking as an act of execution, the offense could only be attempted theft, if at all. Thus, under Article 308 of the Revised Penal Code, theft cannot have a frustrated stage. Theft can only be attempted or consummated.
In that case, the accused were sighted outside the Super Sale Club, a supermarket in SM-North EDSA, by a security guard who was then manning his post at the open parking area. The accused were able to bring the merchandise outside the supermarket and boarded a taxicab at the open parking area. They were apprehended before leaving the parking area. The accused were convicted by the lower court with the crime of consummated theft, but they argued that they should only be charged with frustrated theft, as they didn’t have the opportunity to dispose of the merchandise.

Bumili po ako ng bag sa isang kilalang mall. Naka-sale po ang bag kaya Php 2100 nalang. Pero sabi ng salesman, 1500 nalang daw. So kinuha ko na kasi ang-laki ng discount. Pero hindi pinabayaran sakin nung salesman sa Cashier bagkus ay kinuha nya sakin ang 1500 pero walang resibo. Pinayagan naman ng guard na makalabas yung item. Kinuha nya sakin ang 1500 nung nakalabas na kami sa Mall. Alam ko pong mali kaya gusto ko po sana ibalik yung bag kaso wala akong resibo. Nakakapagtaka lang na nagagawa nila iyon sa isang kilalang Mall. Pwede kaya akong sumabit dito, Atty? Please help me po.

Dati po sa pinagta-trabahuan ko ay nagastos ko po ang pera sa pambayad ko sa pinaghiraman konng pambayad sa hospital. Sinabi ko po sa boss ko yun ngunit huli na at unti unti ko po ito binayaran hanggang ito ay 5,000 pesos na lamang ang natitirang balanse ko. Ant willing po ako bayaran ito. Kinausap ko rin siya dati na kung pwede ipambayad nalang ang balanse ko sa bill ng globe kasi ginamit nila ang pangalan ko sa linya ng telepono sa opisina at hindi nila ito nababayaran hanggang sa ito ay lumaki. Hindi rin kami binigyan ng 13 month pay nung nakaraan taon. Ngayon hinahanap nya rin sa akin ang mga resibo ng aming mga pinamili para sa opisina buong ng buong taon na sa pagkakaalam ko ay nadala ko na sa kanila. Binigyan nya ako ng hanggang November 10,2017 para maibigay ang mga reaibo mag audit daw kasi sila. Ngunit wala na ito sa akin. Sasampahan daw nya ako ng theft pag hindi ko ito naibigay. Ano po ang gagawin ko? Makukulong po ba ako?
