What’s in a Name? Change of Name Without Going to Court

A name, according to the Supreme Court in a 2005 case, has two parts: (1) the given or proper name and (2) the surname or family name. The given or proper name is that which is given to the individual at birth or at baptism, to distinguish him from other individuals. The surname or family name is that which identifies the family to which he belongs and is continued from parent to child. Parents are free to select the given name of their child, but the law fixes the surname to which the child is entitled to use.

Middle names, on the other hand, are not regulated by law, although the Filipino custom is to use the mother’s surname as the child’s middle name. Still, you cannot drop or delete your middle name. Middle names serve to identify the maternal lineage or filiation of a person as well as further distinguish him from others who may have the same given name and surname as he has.

How about an illegitimate child whose filiation is not recognized by the father? Can that child use the middle name of the mother? The answer is, no. That child “bears only a given name and his mother’ surname, and does not have a middle name.  The name of the unrecognized illegitimate child therefore identifies him as such.”

An illegitimate child may now use the surname of the father. This is a recognition of the fact that illegitimacy is not the child’s fault, and, therefore, the child should be shielded against the social stigma and other negative consequences arising from illegitimacy. To illustrate, what’s your first thought should you notice that a kid uses the name of the mother, and not of the father? Even the illegitimate child’s friends and contemporaries in school, should they learn that, unlike them, their friend follows the surname of the mother, would start asking why.

Another welcome amendment is with respect to the procedure in changing names. Going to court, with all the expenses that goes with it, to change first names and correct clerical errors is no longer necessary. Under Republic Act No. 9048 and its Implementing Rules and Regulations, the city or municipal civil registrar or the consul general is authorized to correct a clerical or typographical error in an entry and/or change the first name or nickname in the civil register without need of a judicial order. It must be made clear, however, a court order is still required for substantial changes such as surname, gender, nationality, and status.

R.A. 9048, which took effect on 22 April 2001, amends the Civil Code (Articles 376 and 412), which prohibits the change of name or surname of a person, or any correction or change of entry in a civil register without a judicial order. The matters that you need to know (Primer) about R.A. 9048 is found at the National Statistics Office (NSO) website.

What is the law about changing my child’s last name to my current husband. I got my son when I was still single and he is under my surname. His biological father was also at the birth certificate. Is there a away where we could change his last name?

I have a question regarding the mIddle name
instead of putting my surname as my sons middle initial is it okay to put my husband name same as US or other country is doing?

      Example:
mother name: Corazon Ocampo Bingcol (filipina)
husband name: Eilia Hana Hasabou (LEBANESE)
      Son name: Andrew Eilia Hasabou

      Instead of
      Andrew BINGCOL Hasabou
      I will put
      Andrew EILIA Hasabou

Kindly help coz until now my baby name is not yet registered.

I have a friend who uses the surname of her adoptive father who is now the husband of her mother. While still in college, she applied for an NSO birth certificate, but the one issued to her would bear another surname, supposedly of her biological father. Upon receipt of the birth certificate from NSO, she requested for a CENOMAR of his father, but there’s no record of marriage, meaning she’s illegitimate. Now she cannot take licensure exams or apply for a permanent post in the gov’t because of the discrepancy in records.
What is the best thing to do?

Hi. My name is Yuri. My problem is, my dad is an a**hole (sorry for the term but i can’t think of any other fitting word to describe him) and i dont want to have anything to do with him anymore, including his surname.

Any chance i can remove my surname and maybe use my mother’s instead?

    Parvus,

In case an illegitimate child wishes to use the surname of his mother’s husband (but not the child’s biological father), he could be adopted by the husband. Another way is to simply file a petition for a change of surname, although this is not always granted by the courts.

    Ramon,

Maybe it’s a coincidence that we are about to file a petition that’s somehow related to your query. Still, for the sake of discussion and for the information of everyone, maybe you could give us a brief discussion on which remedy you’d pursue (and why). Thanks.

A female friend got a copy of her birth certificate from NSO Main. It turns out that she is denoted as a “male”.

She has a 1956 copy of a birth certificate issued by the Civil Registrar of Batangas where she is properly described as “female”.

She is choosing between 2 remedies:
    1. petition for the correction of entry in the civil registry to be filed in the RTC, Bats. City
    2. a petition for mandamus to compel the NSO to correct the mistake, given the fact that her evidence is a document from the civil registrar himself, albeit issued in 1956.

Ramon, thank you for the discussion. I believe your discussion amply shows that Rule 108 is the proper remedy in correcting an erroneous designation of gender as it appears in the civil registry.

For the sake of discussion: It could be argued that the Civil Registrar General’s act of recording a Birth Certificate, received from the local office of civil registry, is a ministerial act. It could also be argued that the determination of whether ANOTHER Birth Certificate, containing information different from that officially in its records, is NOT a ministerial act, but an act which calls for the exercise of discretion. In other words, it is beyond the ambit of mandamus. I may be wrong, of course (as noted so many times before, please don’t consider this as a legal advice or legal opinion on any actual matter).

  6. ramonsd

I would choose remedy #1 as RA 9048 seems to be straightforward enough when it says that clerical or typographical errors may be corrected EXCEPT corrections involving the change in SEX, age, nationality and status of a person. As such, I would think that Rule 108 should apply.

However, some are of the opinion that since her main supporting document is a birth certificate issued by the civil registrar, albeit in 1956, it turns the whole matter into a mere ministerial correction which may be subject to mandamus.

It is further argued that since the source document is clear, then it is logical to conclude that the error was in the encoding by the NSO. Therefore, having to go to court to have the entry corrected would be tantamount to allowing the NSO to neglect the performance of a duty resulting from an office, trust, or station.

I, on the other hand think that, since she would have to go to court anyway, either by virtue of R65 or R108, it would be more prudent to follow procedures duly established by law instead of stretching an argument as to what specific acts are covered by mandamus.

I guess if I were wrong, the worst that could happen is that my friend gets inconvenienced by having to travel to Batangas rather than just staying in Manila to file a mandamus case. Either way, given her evidence and the fact that she really IS female, the end result would be the same.

What do you think are other practical implications of choosing one remedy over the other?

hello atty, What is the law about changing my child’s last name to her biological father or even just my last name? I’m planning to have my baby next year here in kuwait and apparently i have to use my “ex-husbands name” since i have been married to him 10 years ago just to make it legal for me to have my baby here. (we’ve been separated for more than 7 yrs now) is it posible for me to register her name under her biological father or even under my name here in kuwait? or IF not, is it posible to change it in the philippines later? let’s say in a year or two. I’m planning to keep her here for 2 yrs. then we’ll go back in the philippines after.

    Thank you so much.

My concern is same with nikkabebez… hope I could have some advice or opinion on this. My kid knows what her father’s last name is and she then gets mad if I come across of telling her that her last name should be like this and that. She’s only 6 but she understands what went wrong between me and her father. She keeps on insisting that she has the same last name as mine and she wants it that way. How can I go about on changing her last name back to mine? Hope to have some feedback.

    Hi Atty,

I am a Filipino married to an American. I have 2 daughter, both I had when I was single in the Philippines They both have my maiden name ( Their birth certificates dont have their biological father’s name). We all have green cards but are not American Citizens yet. Our Philippines Passport have already expired and I’m planning to have them renewed. My questions are:

    1. If I have my family name in my Philippines Passport changed to my married name, how will this affect my 2 girls who sill have my maiden name when going out and back to the country? What documents do I need to present? ( Birth Certificates? Marriage certificate?)

    2. Is it alright ot retain my maiden name in my Philippines Passport even though I am married? When we visited inthe Philippines in 2009, they asked me to present supporting documents why I have different family names in my passport and plane ticket.

    3. How advantageous is it to have dual citizenship? My husband and I are planning to move to the Philippines when he retires.

    4. I am already eligible to apply for U.S. Citizenship, should I just wait ’till I have my new citizeship and acquire a U.S. passport? By then I may have myself and my 2 girls have the same family names.

    Good day!

I am hoping to have a minor name change. My first name in both the original and NSO birth certificates is written as ‘NATHANIE’ instead of ‘NATHANIEL’. Ever since childhood I have always been mistaken as a girl/woman. And ‘Yes’ I am a man. It was a clerical error. I remember a lot of episodes in my life wherein various government offices would deny me of documents due to uncertainties of either my name or my gender. My family have not pursued a name change before due to the painstaking court procedures and the costly expenses it pertains.

I do not have two documents to show as a basis for my name to be changed. The only document that I have wherein ‘NATHANIEL’ and not ‘NATHANIE’ is written is my Baptismal Certificate. Unfortunately, all of my present documents had depended heavily on the original birth certificate with error. I would gladly appreciate any possible remedies. Thank you.

    Hi Atty,

I just want to inquire about my problem in SSS ID regarding my married name “Montes”.

Here’s the story how i got that name. When I got married in Kuwait that is in year 2005, i apply in SSS Kuwait for a change new name from Marlene Pablico Bolactia to Marlene Bolactia Montes. That was approve and i used it till year 2008. But unfortunately when I got home to Philippines, I found out while getting my marriage contract certificate in NSO that i am a CENOMAR person. Then I followed that to DFA and pass a request form about that problem. 2 years passed of following up the problem the solution was not found because the Philippine Embassy never fax a copy of my marriage certificate to DFA. And worst to find that the reason of all of this is my husband that is stayed in Kuwait. He never push through the said paper to passed here in DFA Philippines. Now my husband is dead last January 20, 2013. My big problem is how i will change my married name in my SSS ID to a single name. I went to the office of the SSS to apply for change name but they refuse to do so. If i will apply for widow and change my name i have no marriage certificate, certified true copy from NSO to show because for them i have never been married. Is there anything i have to do so that i can get back to my single name again.

Hope that you understand everything i typed, in any confusion or question, please do not hesitate to email me back (mbolactia@gmail.com).

Thanks and my appreciation for your prompt response.

Hello, i would just like to inquire if my mother’s birth certificate can still be changed, it bears a slightly different variation of her first name and the surname of her mother. My mother and my aunt were illigitimate children but were recognized by my grandfather who passed a way a couple of years ago in the states. We wanted to get a passport for her so she can avail of the benefit of my sister who works in an airline company. Her baptismal certificates, school records, wedding contracts, land title etc, bears the name that she grew up with with the last name of my grandfather, except for the birthcertificate. Can that be done? I’ve read some articles that there should be a letter from my grandfather acknowlodging my mother, but he passed a way already. He left them when she graduated highschool, but continuously writes to her and my aunt till he passed away. Can those letters be used as proof of acknowledgement? Would really appreciate a reply on how to go about this if its possible..thank you

My ex and I were together when my son was born and I mistakenly gave my consent to use his father’s last name upon birth certificate registration assuming that he would play an active role in his son’s life. Well, he has not seen my son for almost 3 years and has never paid child support. He just left my son with my mom as I am working abroad. Our relationship ended 3 years ago and we are not even married as he is married with his first wife. Even though his name is on my son’s birth certificate, does anyone know if it is possible to change my son’s last name to mine without getting his father’s consent? How can I change my sons last name? Every single money he don’t give any support to my son the day he abandoned my son even asking hows the kid he didn’t bother to do that. And now I want to change my sons last name to mine for me also to easily process all docs because i want him to come with me abroad even just for a vacation. Please help…

    hai atty..

Gud day.. i have question regarding my situation.. i was born MARCH 20, 1992 wen i was born my father and my mother are not yet married. then the midwife told my mother this child cannot use her father`s family name because of the absence of married. so i register as SHEENA PERALES CUESTA as the sure name of my mother, late 1992 the court allowed the illegitimate children to use the sure name of there father but my case my father in that time is in abroad so my family name in NSO is still CUESTA. Wen i`m 7 years old and to go school my mother register me in school as SHEENA CUESTA MOLINAS in short i bear the sure name of my father with out acknowledgement sign of my father because he is still in abroad and, until now i uses the surname of my father in all transactions, id`s, and school records.
Today my father and mother are separated because my father have his own family in abroad and i have no contact to him. i want to get a passport but there is a problem occurred, my NSO birth certificate and my SCHOOL RECORDS are not fixed.. what should i do to get passport? please help me. GOD BLESS..

Hi! A new birth certificate will NEVER be issued. The annotation in your birth certificate is a sufficient proof that you had already changed your name.

hi, i have a question. my boyfriend is having trouble getting a passport due to an error in his last name on his NSO BC. he has always used De Leon on all of his documents. as it turns out, the NSO copy is showing the middle name “Bautista De” and the last name “Leon”.

Could this be considered as a clerical error? Will he still need to go to court to clear this mess up?

Hi, I am American and my wife if Filipina. Please assist me in answering a question on what her name can be on her passport. You see, when we married here in Los Angeles, my wife, unknowingly, use her proper first name, my surname, but changed her middle initial to her mother’s name. When we went to the Philippine counsel to update her passport she was told that it was against Philippine law to use her mother’s name and that she could only use her father’s name as a middle initial. All of her American official Documents where produced with her mother’s middle name on them. Is there a legal way to fix this or how can she get her passport to match her American documents, i.e. (keeping her mother’s name as her middle initial. Help, am so confused (:-) Thank you.

Not all divorced, annulled or separated mothers want their children to carry their father’s name as surname. The child’s welfare should always be the primary reason for change of names . A new breed single mothers have risen and for one very good reason or another, most of them if not all of them, do not want their children to carry the name of the good-for-nothing “father” .
A child not having the same family name as his/her single mom makes people more curious.
A child not having a middle name is equates illegitimacy. This is not true for children from divorced, annulled or separated parents. They remain legitimate.
The main purpose of middle names is to determine maternal lineage. So it is more logical to use the mothers family name as middle name and surname since using the mother’s middle name would make them appear to be siblings. The father’s name will forever be in the birth certificate anyway.
Confusion and stigma cannot be avoided but it can be lessened.

Good day sir! i just need your legal advice regarding my situation. I am already 25 years old, but I i still don’t have a “legal” identity, per se. When I was born on April 1990, my mother, who was then a minor, was instructed by family members to put in my biological father’s last name in my birth certificate. As things turned out, my biological father did not really acknowledge me and left. My mom then married my step-father, and ever since, I have been using my step-father’s last name, since kindergarten up until I graduated from college. We have been seeking legal advice but so far the only option I have is to either adopt the family name in my birth certificate (which I don’t want to do) or apply for an adoption process (which would take a very long time). With the approval of the RA 9048, are these still the only options I have? Thank you so much for any information you can provide me in light of this matter.

    Hi Atty. Fred,

I’m trying to fix my records and eventually get a passport. My question is if my name indicated in my birth certificate indicates “Juan Cruz” (not my real name, just an example). But eversince my baptism when a second name was added I’ve used “Juan Miguel Cruz” in all other documents like SSS, School transcript, Driver’s license, voter registration, children’s birth certificate, marriage contract, etc.

Which one is easier to process (and less hassle and/or cost). Changing my birth certificate to “Juan Miguel Cruz” or changing all my other documents to just “Juan Cruz”. I’ve heard conflicting comments that one is easier or faster than another and vice versa so wanted to get your thoughts on this.

    Thanks in advance!

    Hi Attorney,

    Hope to get your assistance.

My niece is using her Mother’s Middle Initial & Surname since birth. Her mother which happened to be my sister was not married to my niece’s father. The father’s name is apparently mentioned in the birth certificate & he has a signature on the Affidavit of Acknowledgement/Admission of Paternity at the back page copy of the birth certificate.

We just want to know what is supposed to appear in the birth certificate if my niece has the above case.
Currently, The birth certificate shows the below details:

    Mother’s name: Myla Gulpe Taduran
Father’s name: Ryan (Middle Name) Asa

Child’s Name: Kim Rhianne Gulpe Taduran

Some told us that this should not be entered like the above, since it will appear that Myla (the mother) & Kim Rhianne (the child) are siblings instead of Mother & Child.

    My questions are as follows:
    1. What should be the correct entry of my niece’s name on the birth Certificate?
    2. Do we need to go for the amendment procedures omitting / deleting the Middle Name which is “Gulpe”?
    3. Or can we retain the Middle Name “Gulpe”?
    4. What would be the public documents to present if we will proceed on amending / omitting the Middle name?
    5. In case my above questions are not sufficient to settle / arrange the birth certificate the way it should be, please advise what would be the proper procedures to do it so.

Appreciate your most valuable & swift assistance as possible.

    Thank you.

Are there any specific grounds/requirements that the court would need before being able to grant a change in last name?

I ask regarding a very peculiar set of circumstances and am confused as to what to use as the last name. Preferably would want the last name of the biological father/mother.

SPECIFICS: Child (X) of Parents (A) & (B) [unmarried]. (X) is adopted and/or merely raised by the female sibling (C) of male Parent (A). (C) was married to (D) [deceased]. (C) now married to (E).

P.S. How much fees/cost would be incurred to have all the mess of it fixed and also how long would it take, if at all possible?

Hi Attorney, my brother is living in US and has authorized me as his sister to check his SSS status/pension as he is now 61 years old. We requested a copy of his birth certificate at the NSO and we received a copy of different first name. My brother sent a letter to the Civil Registry Office where he was born to request for the change of first name pursuant to Republic Act 9048. He also attached his SSS records, High school certifications, copy of birth certificate from NSO and birth certificates of our parents to prove that the present first name that he is using is the first name that he has been using since he was a child and not the first name indicated on the NSO copy. The Civil Registry replied that since my brother is already in USA, my brother must submit a FBI clearance. Is it true that my brother needs to furnish a copy of FBI clearance. He is now a senior and just want to claim his SSS pension here in the Philippines. Thank you

Is it okay for him to use my surname now that he is in junior high? Will that cause any legal problems in the future especially with his school records? I don’t want to change my son’s surname. Thank you.

In my birth certificate, my biological mother is my sibling in papers. My grandmother is listed as my mother as well as my grabd father is listed as my grandfather in my birth certificate. How is the process in changing my mothers name to my biological mother? They put it that way because my biological father leave my mom when he knew that my mother was pregnant with me.

    Good day,

I have few concerns, I am legally married to a Canadian citizen and been separated for a long time. Few years after a separation I have relationship with other men and got pregnant.

During the pregnancy things was not okay with my new relationship and decide to end it. But he was present the day I gave birth to my daughter.

In the hospital where I gave birth, The people from live birth records told us that I can’t put the baby as the biological father’s name as I was still married to my Canadian husband and as my legal husband he is the one entitled and have the legal rights on the birth certificate which my husband agreed on. Also because the biological father act as an sperm donor in away.

However, despite of what hospital told us my Daughter has been registered to my ex boyfriend’s name without my permission. I don’t know who registered my daughter to his name as it doesn’t indicate who registered my daughter and my husband already claimed my daughter to be his and to protect me and my daughter from my ex boyfriend.

I am still married to my husband now and he take responsibilities to my daughter. We want to register my daughter in muntinlupa but as we got the record from the hospital they ask for the certificate of no record of my daughter but when we check at NSO she was registered by unknown persons name.

I could not register my daughter to my husband’s name using the record and information given by the hospital because someone already registered her in my ex boyfriend’s name without informing me.

In order for me and my husband to get the papers we needed. We have broken the law for the sake of our daughter. And we both decided to register my daughter in other different location where she was original been born and put she was home birth.

We know that my husband and I can be in trouble because of what we did, but whatever we did was for the sake of our daughter.

Now my ex boyfriend want to claim my daughter because he is in the birth certificate which we did not register and was told my hospital not to register my daughter to ex boyfriends name as it is against the law.

My question is: what penalty should we be getting in the future? And is it possible to request to have the birth certificate registered to my ex boyfriend be void? My daughter is now registered to NSO and we put I gave birth at home for the record and not hospital. Is it possible to change where my daughter is born? What are the steps I need to be doing to make everything right for my daughter?

Please, I hope you can help me.

    Thank you,

    A

I want to change my son’s middle name and all I get from lawyer here and local registry is I MUST go to court! this contradicts all I have read.
“Law Is Silent As To The Use Of
    Middle Name –
As correctly submitted by both parties, there is no law regulating the use of a middle name. Even Article 17611 of the Family Code, as amended by Republic Act No. 9255, otherwise known as “An Act Allowing Illegitimate Children To Use The Surname Of Their Father,” is silent as to what middle name a child may use.
Please direct me to someone who can help I am in General Santos.

    Hello po,

Pwede po ako makahinge ng advise. May prob po ako. 2 po ang Birth Cert ko isang Kenly Sedano Perida ( (late registered, Perida is the surname of my father) at isang Joan Sedano (1st registered apilyedo ng mama ko, no father appeared sa birth Cert ko). Since pagkabinyag sa akin kenly S. Perida na gamit ko, i and we never knew na existed ang Joan Sedano. Last year po kumuha po ako ng NSO but ang binibigay nila is Joan Sedano. Is there any way na pwedeng baguhin ang school records ko from Perida to Sedano?

    Thank you po.

I have a question regarding the change of my daughter’s surname from his father to mine? I was married to the father of my child last march 2014 through civil wedding. We only lived together for about a month then I returned to my parents roof after a month. I was 4 months pregnant then. By mid June 2014, he left without a single word and never returned since then. I had no idea of his whereabouts from then on. His parents and siblings were kinda telling me to forget him and stop pursuing my marriage with him..how could it be when we were legally married? He didnt comply to his paternal responsiblities to our child from pregnancy to birth til now. And lately, i learned that he is a gay and he is now in a relationship with the same gender as him. That’s why i made my decisions to change my daughter’s last name to mine since i shoulder all the parental responsibilities to my child. And plus the thought that i dont want my child to be bullied around when she reaches the school age. Thank u for the reply.

    Hi Sir,

Good Day! I hope this finds you well.

I would just like to know, if it can be possible for me to change my last name from my Father’s to my Mother’s last name?

I am now 29 years old. My parents were not married when I was born. From the beginning of the pregnancy, until to date, my father never performed any paternal duties to assist my mother in raising me. I just knew my father because I searched for him and sometimes asks for some time from him to bridge the gap.

Before I was born, he already got a son with another woman. He is currently based in the US and I knew him personally because I introduced myself to him when I was able to search for him via Friendster. I got the information about my brother’s name from my mom. My father never introduced us to each other. We just did our best so we can align our plans and finally meet when he was already 28 years old and I was 26 years old.

My father also got married several years ago, and had a currently 15 years old daughter with his wife. His daughter knew my older brother, but never knew anything about me. I tried to do something to connect myself with her but my father didn’t want me to communicate with her as he has no plans of doing it by that time and he said he is planning to do it at a later time when she can understand. His daughter was 9 years old then, and she is 15 years old now. But still, my existence to his daughter and to his entire clan was an unknown story.

During my 29 years of living, I never knew anyone from his side of clan, aside from him and my older half-brother, and he’s never planning anything to make it happen. This was the reason why I think my last name is irrelevant for me to use, and I have been thinking about changing it for the longest time and now is the time that I have already decided that I really want to do it.

I hope you can give me an advise, on the feasibility of changing my name. I want to use my mother’s last name, because in the first place, the family that I’ve known all my life was just her family.

    Thank you in advance.

I was bullied in my elementary years because my name has ‘Princes’ in it. I judt tolerated it until college. I went overseas and of course people would like to know my name. Whenever they learn about my first name they either tell me ‘what a lovely name’ or would ask me ‘what is your real name?’ ‘Is that your real name?’ (Annoying right?!)

My concern is if it’s possible to change my first name without going through the lenghty process?

I’m currently living overseas and don’t have a luxury of time to go home due to studies and work committment.

Hi. I would just like to ask about baby naming. Im about to deliver our baby this nov but the problem is we are not yet married. We plan to get married after the baby is delivered. I am a filipina and the father of my child is an indonesian which they dont require their kid to have their surnames. Their kid mostly use their mother’s surname even if they were married. Because most of indonesians dont have surnames it just happened that his name is Hendra Putra (which means boy in indonesia) – not really their family name but a name chosen to use as their surname – but our kid will be a girl. Can you give me an advice on how to name our baby? Will she be illegitimate if she use my surname even if we got married here in the phil? Thankyou for your response.

I do not have even a little blood of Filipino in me. Now I own a Philippine and French passports.. I want to apply for work in France using my original name so I won’t need visa anymore and that I can claim my identity. How is it possible to fix?
